Don't miss your emergency plan's renewal date

Employers in Türkiye must prepare an emergency plan (Law No. 6331, Article 11(1)) and renew it at least every 2 years in very hazardous, 4 in hazardous and 6 in low-hazard workplaces (Emergencies Regulation, Article 14(2)). It is renewed earlier if changes affect the emergencies; breaches carry a fine.

Under Türkiye's Occupational Health and Safety Law No. 6331, the employer identifies possible emergencies, takes measures to prevent and limit their effects and prepares emergency plans (Law, Article 11(1)). The Regulation on Emergencies in Workplaces sets out how the plan is prepared and when it must be renewed.

By hazard class, the plan is renewed at least every two, four and six years in very hazardous, hazardous and low-hazard workplaces respectively (Regulation, Article 14(2)). The plan shows the date it was prepared and its validity date (Article 12(1)(c)).

The plan must also be renewed fully or partly before then if changes in the workplace or its surroundings could affect the identified emergencies or create new ones (Article 14(1)).

Who is responsible?

The employer prepares the plan and ensures drills are held (Article 5(1)(ç)). Where there are subcontractors, the main employer is responsible for the workplace as a whole and each subcontractor for its own work area and activities (Article 18(1)). Where several employers share a work area, they prepare the plan jointly; in business centres, office blocks and industrial estates, the management coordinates the plans (Article 17).

If the deadline passes

An employer that breaches Article 11 of Law No. 6331 is subject to an administrative fine for each obligation not met, and the same fine for each month the breach continues (Law, Article 26(1)(d)).

What must the plan contain?

The workplace's name and address and the employer's name; who prepared it; the preparation date and validity date; the identified emergencies; preventive and limiting measures; response and evacuation methods and an evacuation plan (Article 12(1)). The pages of the plan approved by the employer are numbered, each page is initialled and the last page signed by those who prepared it; plans signed with a secure electronic signature are also valid. The plan is kept at the workplace where the emergency teams can easily reach it (Article 12(2)), and the evacuation plan is posted visibly at entrances, exits and on each floor (Article 12(3)).
