Keep your dangerous goods insurance policy continuous

In Türkiye authorisation certificate holders must present the compulsory dangerous goods liability policy when obtaining permission for vehicles carrying dangerous goods or hazardous waste (Road Transport Regulation, Article 12(1)). Cover runs between the policy dates, from 12:00 noon unless agreed otherwise (A.5).

Under Türkiye's Road Transport Regulation, authorisation certificate holders must obtain separate permission from the relevant authorities for vehicles carrying dangerous goods or hazardous waste, by presenting information and documents showing the vehicle suits the goods and the compulsory dangerous goods and hazardous waste liability insurance policy (Article 12(1)).

The insurance covers the liability of persons carrying out professional activities with the dangerous substances covered by Decision No. 2010/190 for bodily injury and property damage suffered by third parties in an accident arising from those activities, regardless of fault, up to the amounts in the policy, and must cover all of the insured's activities within the Decision's scope (General Conditions A.2). Cover starts and ends at 12:00 noon Turkish time on the start and end dates written in the policy, unless agreed otherwise (General Conditions A.5).

Producers or cylinder-filling companies may combine the policies that carriers must otherwise take out one by one into a single "group" policy; the policy then lists each carrier's vehicle plate, registration number and the operator's name or trade name (Tariff and Instructions I.B.3).

Who is responsible?

The authorisation certificate holder; it presents the policy when obtaining permission for its vehicles carrying dangerous goods or hazardous waste (Road Transport Regulation, Article 12(1)). The first premium instalment is paid at the latest when the policy is delivered; if it is not paid, the insurer's liability does not start (General Conditions C.1).

If the deadline passes

Anyone acting against Article 12(1) of the Road Transport Regulation is subject to the administrative fine set in Article 26(1)(b) of Road Transport Law No. 4925 (Article 12(1)). If the policy is cancelled for any reason, the insurer reports it with the reason to the authority that issued the permit or licence and to the Insurance Information Centre (General Conditions C.5).

The policy term is not fixed by law

The General Conditions say cover starts and ends on the dates written in the policy (A.5); they do not set a fixed term. So enter each vehicle's policy end date in ExpirySuite rather than relying on a default period.
