Keep your OHS service contract up to date in İSG-KATİP

In Türkiye the OHS service contract with in-house OHS staff or with an OSGB follows the İSG-KATİP template and is approved in the system within five days (OHS Services Regulation, Article 14(3)). Unapproved staff may not start work (Article 14(7)); termination is reported within five working days (Article 14(9)).

Under Türkiye's OHS Services Regulation, if the workplace physician, OHS specialist and other health staff are appointed from among the employees, a contract is signed between them and the employer; if services are bought from a joint health and safety unit (OSGB), the contract is between the OSGB and the employer (Article 14(1)). The contract follows the template in the İSG-KATİP system and is mutually approved in the system within five days at the latest (Article 14(3)(a) and 14(3)(b)).

A workplace physician, OHS specialist or other health staff member whose contract or appointment has not been approved by the Directorate General may not start work or use their powers (Article 14(7)). Every OHS service an OSGB provides to a workplace requires a contract through İSG-KATİP (Article 14(11)). The regulation sets no contract term; at the end of the contract the OSGB hands all records and files over to the employer, even if not asked (Article 13(2)).

The employer is responsible for ensuring that the physician, specialist and other health staff it appoints, and the OSGB it uses, work under a valid authorisation certificate (Article 5(7)). OSGB authorisation certificates must be endorsed (vize) every five years; if an OSGB does not apply in time, its certificate is suspended until the endorsement is completed (Article 20(1) and 20(2)), and a suspended OSGB may not use its powers under the regulation (Article 22(2)).

Who is responsible?

The employer. Its obligations continue even when it buys services from an OSGB (Article 5(6)). Termination or loss of validity of the contract or appointment document is reported via İSG-KATİP within five working days: by the employer for in-house appointments, by the OSGB for external services (Article 14(9)).

If the deadline passes

An employer that does not appoint an OHS specialist or workplace physician with the qualifications set under Article 6(1) of Law No. 6331 is fined for each person not appointed and for each month the breach continues; the same applies to not appointing other health staff (Law, Article 26(1)(b)). An OSGB found to have signed contracts or provided services while its certificate was suspended has its certificate cancelled outright (Regulation, Article 22(4)(c)).

Track the specialist's or physician's certificate too

The employer is responsible for ensuring the people it appoints and the OSGB it uses hold valid authorisation certificates (Article 5(7)). See our separate guide on endorsing OHS specialist and workplace physician certificates; you can also add the OSGB certificate's five-year endorsement date as a separate record.
