Don't let your ADR certificate of approval lapse

In Türkiye the ADR certificate of approval for EX/II, EX/III, FL, AT and MEMU vehicles carrying tanks or Class 1 goods is valid for at most one year and issued annually (Dangerous Goods by Road Regulation, Articles 4(1)(b) and 6(1)). The carrier must keep it on the vehicle; carriage without it is fined.

Under Türkiye's Regulation on the Carriage of Dangerous Goods by Road, the ADR certificate of approval (ADR Uygunluk Belgesi) is issued for the vehicles listed in Article 6 under ADR Chapter 9, with a validity of at most one year (Article 4(1)(b)). It is issued annually by the Ministry or the bodies it authorises (Article 6(1)).

It is mandatory for vehicles carrying dangerous goods in fixed or demountable tanks over 1 m³, or in tank-containers, portable tanks, MEGCs and similar units over 3 m³, and for vehicles carrying Class 1 goods, where these are EX/II, EX/III, FL, AT and MEMU vehicles used for carriage to ADR countries (any model year) or used domestically with model year 2015 or later (Article 6(1)(a)). Older vehicles that do not fully meet ADR instead need a vehicle conformity certificate (Taşıt Uygunluk Belgesi), also issued annually (Article 6(1)(c)).

Who is responsible?

The carrier must carry out transport with vehicles holding a valid ADR or vehicle conformity certificate suited to the goods, and keep the certificate on the vehicle (Article 22(1)(a) and 22(1)(b)). The consignor ensures the transport is done with such a vehicle (Article 18(1)(c)); the filler fills tanks only on vehicles with a valid certificate (Article 21(1)(a)).

If the deadline passes

Carriage without a valid ADR or vehicle conformity certificate breaches Article 22(1)(a) and 22(1)(b) for the carrier and Article 18(1)(c) for the consignor; these breaches are subject to an administrative fine per sub-paragraph under Article 28 of Decree-Law No. 655 (Article 36(1)(h) and 36(1)(m)).

When is a vehicle conformity certificate not issued?

For vehicles older than the model years in Article 6(1)(a) and (b), no vehicle conformity certificate is issued if a vehicle status certificate (Taşıt Durum Tespit Belgesi) was not obtained by 1 July 2021 (Article 6(7)). Vehicles that obtained that status certificate by then but did not convert it into an ADR or vehicle conformity certificate may not be used to carry dangerous goods (Article 6(8)).
