Don't miss the yearly inspection of your ventilation and air-conditioning

In Türkiye workplace ventilation and air-conditioning installations must be inspected once a year by authorised persons for conformity with their design project (Work Equipment Regulation, Annex III, 2.3.6 and Table 3). The project is required at the inspection; the employer must have one prepared if none exists.

Under Türkiye's Regulation on Health and Safety Requirements in the Use of Work Equipment, the equipment listed in the Annex III tables is subject to periodic inspection, carried out by persons authorised to perform periodic inspections (Article 7(1)). Unless the relevant standards say otherwise, installations are inspected once a year (Annex III, 2.3.1).

Ventilation and air-conditioning installations are listed in Annex III, Table 3 with an interval of 1 year; the inspection determines whether the installation meets the criteria set out in its design project. The design project is required at the inspection, and the installation is assessed for conformity with the project and with good engineering practice (Annex III, 2.3.6).

Who is responsible?

The employer. It ensures periodic inspections are done by authorised persons, records the results with a wet signature or a secure electronic signature, and keeps them to show the authorities on request (Article 7(2)(b) and 7(2)(c)). It carries out, or has carried out, the preparations specified by the authorised person before the inspection (Article 7(4)). Periodic inspection reports are kept for as long as the equipment is in use (Annex III, 1.6).

If the deadline passes

If the report finds non-conformities and states that the equipment should not be used until they are fixed, it is not used until then, and the employer marks it with a clearly visible warning (Annex III, 1.9). Minor defects must be fixed by the start date of the next periodic inspection, otherwise they count as major defects (Annex III, 1.9.1). An employer that fails to meet obligations in regulations based on Article 30 of Law No. 6331 is subject to a monthly administrative fine for each provision not complied with (Law, Article 26(1)(n)).

When is an inspection needed besides the yearly one?

Equipment whose safety depends on installation conditions is also inspected after installation and before first use, after major maintenance and repair, and, if not mobile, after every change of location (Article 7(2)(a)). The necessary inspections are also carried out after events that may impair safety, such as changes in working methods, accidents, natural events or long periods out of use (Article 7(2)(b)). The frequency of tests and examinations can be increased based on a risk assessment (Annex III, 1.10).
