Don't miss your risk assessment's renewal date
The risk assessment that employers in Türkiye must carry out (Law No. 6331, Article 10(1)) is renewed at least every 2 years in very hazardous, 4 in hazardous and 6 in low-hazard workplaces (Risk Assessment Regulation, Article 12(1)). It is renewed earlier after a move, equipment change, accident or near miss.
Under Türkiye's Occupational Health and Safety Law No. 6331, the employer must carry out or commission an occupational health and safety risk assessment (Article 10(1)). Under the OHS Risk Assessment Regulation, the assessment is renewed at least every two, four and six years in very hazardous, hazardous and low-hazard workplaces respectively, according to the workplace's hazard class (Article 12(1)).
The risk assessment document states the date it was carried out and its validity date (Article 11(1)(c)). That validity date is the expiry date to track.
At a glance
| Hazard class | Renew at least every |
|---|---|
| Very hazardous | 2 years |
| Hazardous | 4 years |
| Low hazard | 6 years |
A full or partial renewal is also required before the deadline when the workplace moves or buildings change; technology, substances or equipment change; production methods change; a work accident, occupational disease or near miss occurs; legislation on workplace limit values changes; workplace measurements or health surveillance results call for it; or a new external hazard arises (Article 12(2)).
Who is responsible?
The employer carries out or commissions the risk assessment (Regulation, Article 5(1)). It is carried out by a team set up by the employer: the employer or its representative, occupational safety specialists and workplace doctors, employee representatives, support staff and knowledgeable employees representing all units (Article 6(1)). Subcontractors carry out or commission a risk assessment for their own work and give a copy to the main employer (Article 15).
If the deadline passes
An employer that does not carry out or commission a risk assessment is subject to an administrative fine, with a further administrative fine for each month the breach continues (Law No. 6331, Article 26(1)(ç)).
How is the document kept?
The pages are numbered, each page is initialled and the last page signed by those who carried out the assessment, and the document is kept at the workplace.
