Don't miss the renewal date of your DASK policies

Türkiye's compulsory earthquake insurance (DASK) policy runs for one year and must be renewed yearly by the owner or usufruct holder (Disaster Insurance Law No. 6305, Article 10(3)). If not renewed, DASK's liability ends on the expiry date, and land registry transactions need proof of valid insurance (Article 11(2)).

Under Türkiye's Disaster Insurance Law No. 6305, compulsory earthquake insurance covers independent units under the Condominium Law, buildings built as dwellings on land registered and privately owned, independent units in those buildings used as shops, offices and the like, and dwellings built by the State or with State credit because of natural disasters. Owners or usufruct holders take out the insurance and it is renewed every year (Article 10(1) and 10(3)).

According to the Natural Disaster Insurance Institution (DASK), the compulsory earthquake insurance policy runs for 1 year and must be renewed every year. If it is not renewed by its expiry date, DASK's liability for cover ends on the expiry date stated in the policy.

Buildings subject to the Public Housing Law or used as public service buildings, buildings in village settlements built by people registered in and permanently living in the village, and buildings used entirely for non-residential purposes (even under the Condominium Law) are not subject to compulsory earthquake insurance (Article 10(2)).

Who is responsible?

The owner or usufruct holder takes out the policy (Law, Article 10(3)); according to DASK, renewal is the insured's responsibility. A tenant cannot take out compulsory earthquake insurance in their own name, but can take it out on the owner's behalf as the policyholder (DASK). All insurance companies, their agents and bank branches issue policies on behalf of DASK (DASK).

If the deadline passes

If the policy is not renewed by its expiry date, DASK's liability for cover ends on that date (DASK). Land registry registrations and deregistrations are not carried out without documented valid insurance (Law, Article 11(2)).

Alterations can affect compensation

The owner or usufruct holder must take the necessary measures against the building or its units being altered or weakened contrary to the project in a way that harms the load-bearing system. If damage is found to result from such an alteration, the right to compensation is lost (Article 12). For insured buildings, earthquake damage compensation is paid within thirty days at the latest once the required information and documents and the damage assessment are complete (Article 13(2)).
