A Turkish real estate business needs at least one responsible agent with a Level 5 vocational qualification certificate to obtain its authorisation (Real Estate Trade Regulation, Article 6(1)(ç)). Under qualification 17UY0333-5 the certificate runs 5 years and is extended by 5 with work records or a performance exam.

Under Türkiye's Real Estate Trade Regulation, real estate trade may only be carried out by businesses and contracted businesses holding an authorisation certificate (yetki belgesi) (Article 5(1)). To obtain one, at least one of the business's responsible real estate agents (sorumlu emlak danışmanı) must hold a Level 5 vocational qualification certificate (Article 6(1)(ç)); as a general rule, responsible agents must hold Level 5 (Article 10(1)).

Under MYK national qualification 17UY0333-5 Responsible Real Estate Agent (Level 5), the certificate is valid for 5 years. At the end of that period the holder either submits records showing work in the field for at least two years in total within the 5 years or throughout the last six months, or passes the performance-based exam (P1); holders meeting either condition get a further 5 years.

Responsible agents who graduated from higher education fields related to real estate trade are exempt from the certificate requirement; the Ministry determines those fields (Article 10(2) and (3)).

Who is responsible?

The certificate holder applies for renewal (MYK Regulation, Article 27(2)). The business enters its responsible agents' start and leaving dates into the Ministry's information system within ten days (Real Estate Trade Regulation, Article 11(3)(b)).

If the deadline passes

If a business loses any condition of its authorisation certificate, the certificate is cancelled on the business's own application, which it makes through the information system within ten days, or when the Ministry finds that a condition is not met (Article 9(1)(a) and (b)). When a business's certificate is cancelled, its contracted businesses' certificates are cancelled too (Article 9(2)), and listing agreements valid on the cancellation date are deemed terminated (Article 20(9)).

Don't leave renewal to the last minute

The renewal application must be made before the certificate expires (MYK Regulation, Article 27(2)). You cannot change ExpirySuite's reminder timings, so if you want to prepare earlier, add a second record called "MYK renewal application" with a date of your choice.
