Track the end date of every listing agreement
Real estate services in Türkiye are provided under a written listing agreement between client and business; the regulation sets no term, but the agreement must state one (Real Estate Trade Regulation, Article 15(2)). When it ends the listing comes down within three days and the file is kept five years (Article 14(2)).
Under Türkiye's Real Estate Trade Regulation (Taşınmaz Ticareti Hakkında Yönetmelik), real estate services are provided on the basis of a written authorisation agreement (yetkilendirme sözleşmesi) between the client and the business or contracted business (Article 15(1)). It is made in at least two copies, one for each party, and must state at least the business's authorisation certificate number, the responsible agent's name and signature, the client's details, the services and fees, the parties' rights and obligations, the term of the agreement and addresses for notices (Article 15(2)).
The Regulation does not set a term; the parties set it in the agreement. When the property is sold or let, the sale or letting is abandoned, or the agreement is terminated or expires, the business must stop advertising within three days of that date (Article 14(2)(h)).
At a glance
| Form | Written; at least two copies, one per party (Article 15(1)-(2)) |
|---|---|
| Term | Not set by the Regulation; must be stated in the agreement (Article 15(2)(e)) |
| When it ends | Advertising stops within three days (Article 14(2)(h)) |
| Retention | The agreement and related documents are kept on file for at least five years (Article 14(2)(k)) |
| Extra details for sale and letting | Zoning and occupancy permits, title record, size, age, mortgages and attachments, etc. (Article 15(3)) |

If, during the agreement's term, the property is bought or rented directly from the client bypassing the business that issued the viewing document, the business is still entitled to its fee (Article 20(8)). If a business's authorisation certificate is cancelled, agreements valid on that date are deemed terminated (Article 20(9)).
Who is responsible?
The agreement is made between the business or contracted business and the client (Articles 4(1)(m), 15(1)). The business keeps a physical or electronic file for each agreement (Article 14(2)(k)) and may not advertise anything contrary to it (Article 14(2)(ı)).
If the deadline passes
Listings for an expired agreement must be removed within three days (Article 14(2)(h)), and a business may not advertise a property it is not authorised to sell, market or let (Article 14(2)(j)). Administrative fines under Article 18 of Law No. 6585 are applied by the Ministry for breaches of the Regulation (Article 22(4)).
Only three days to take the listing down
Listings must come down within three days after the agreement ends (Article 14(2)(h)). ExpirySuite also reminds you on the expiry day, and managers get the overdue notice on day 3. You cannot change the reminder timings, so if you want an earlier prompt to discuss an extension, add a second record with a date of your choice.
