Don't let your ART contract anniversary catch you off guard
Every employer in Argentina that is not self-insured must join a workers' compensation insurer (ART) (Law 24.557, Article 27). The contract runs for at least one year and renews automatically for another year unless the employer insures with a different ART at expiry (SRT Resolution 46/2018, Articles 12 and 14).
Employers that are not self-insured must join the workers' compensation insurer (Aseguradora de Riesgos del Trabajo, ART) of their choice and report new hires and leavers (Argentina's Occupational Risks Act 24.557, Article 27.1). Membership is set out in a contract whose form, content and term are set by the Occupational Risks Superintendency, SRT (Article 27.3).
The contract runs for at least one year, counted from midnight on the start date set in the Digital Policy Application (SRT Resolution 46/2018, Article 12). If, when that term ends, the employer has not insured with another ART, the contract renews automatically for another year (Article 14); the Act provides for automatic renewal at the premium rates in force on the renewal date (Act 24.557, Article 27.4).
The employer may switch insurer once six months have passed since first joining an ART and, after that, no more than once a year (SRT Resolution 46/2018, Annex I, sixth clause). When applying for cover after a switch, the employer must first have obtained a Certificate of No Objection (Article 6), and a termination for switching ends on the last day of the calendar month (Article 17).
At a glance
| Term | At least 1 year from the start date in the Digital Policy Application (SRT Res. 46/2018, Article 12) |
|---|---|
| Renewal | Automatic for another year unless the employer insured with another ART (Article 14; Act 24.557, Article 27.4) |
| Switching ART | After 6 months from first joining; then no more than once a year (Annex I, sixth clause) |
| Switch procedure | Needs a Certificate of No Objection; termination falls on the last day of the month (Articles 6 and 17) |
| Annual Prevention Programme | Filed on signing and updated yearly with the ART (Annex I, fifth clause, I.c) |
| Non-payment | The ART may end the contract if two monthly instalments are unpaid or the debt equals two instalments (Act 24.557, Article 27.6) |
The Digital Policy Application states the cover start date and end date (SRT Res. 46/2018, Annex I, particular conditions, items d and e).
Who is responsible?
The employer: it must join an ART, report hires and leavers (Act 24.557, Article 27.1) and file and update each year with the ART its Annual Occupational Risk Prevention Programme (SRT Res. 46/2018, Annex I, fifth clause, I.c). It must also tell workers which ART covers them (fifth clause, I.j).
If the deadline passes
An employer that is not self-insured and fails to join an ART is directly liable to beneficiaries for the benefits under the Act (Act 24.557, Article 28.1). If the ART ends the contract for non-payment, the employer is treated as uninsured and is in that same position (Article 27.6). The Act provides for imprisonment of an employer who fails to pay the instalments or to declare their payment (Article 32.3), an offence that arises if the employer does not comply within fifteen calendar days of formal notice at its legal address (Article 32.6).
Automatic renewal doesn't mean there is nothing to track
The contract renews by itself, but each anniversary is when the employer can decide to switch insurer (Annex I, sixth clause) and when its Annual Prevention Programme must be up to date with the ART (fifth clause, I.c). The ART must report to the relevant register employers that did not file the General Occupational Risk Survey on joining or on automatic renewal (fifth clause, 2.b).
Tracking it with ExpirySuite
- Add the company (or each insured tax ID, CUIT) and record the cover end date shown on the policy as the expiry date.
- Email reminders arrive 60, 30, 14, 7 and 1 day before that date and on the day itself, giving you time to decide whether to renew or switch ART.
- The broker or the ART can upload the renewed policy through a secure link that is valid for 14 days and needs no account.
- Assign a responsible person, such as HR or the health and safety team; if the date passes without a new policy, managers get further reminders 3, 7 and 14 days later.
