Never let a foreign employee's temporary residence expire unnoticed

Argentina's National Migration Directorate (DNM) grants migrant worker temporary residence for one year, extendable for another (Law 25.871, Article 23(a)). The extension is requested in the 60 days before expiry; up to 30 days later it is accepted with a surcharge, then the right lapses (Decree 616/2010, Article 12).

Argentina's Migration Act 25.871 defines a migrant worker as a foreign national who enters the country to carry out a lawful, paid activity, with authorisation to stay for up to three years, extendable, with multiple entries and exits and permission to work as an employee (Article 23(a)). The National Migration Directorate (DNM) is the enforcing authority and handles the granting of residence and its extensions (Articles 105 and 107).

According to the procedure published by the DNM, temporary residence as a migrant worker is granted for one year, extendable, and the extension is also granted for one year. To obtain it, the applicant submits, among other requirements, a pre-employment contract with certified signatures, proof of the employer's registration with ARCA and in the Single Register of Sponsors of Foreign Nationals (RENURE), and the early registration of employment within 30 calendar days of starting the application; for the extension, proof of continued employment or a new contract, the employer's CUIT and the employee's CUIL and, if the employer changed, the new employer's RENURE registration (DNM procedures).

Extension requests must be made within the 60 days before the temporary residence expires, and the extension period runs from the expiry of the original period (Decree 616/2010, Annex I, Article 12(d) and (e)). Anyone who comes forward voluntarily within 30 days after that deadline pays a surcharge on the fee; once those periods have passed, the right to request the extension lapses automatically (Article 12(f)).

Residence is national and is processed by the National Migration Directorate (Act 25.871, Articles 105 and 107). The resident must start the national ID (DNI) procedure within 60 days of being notified that residence was granted (Decree 616/2010, Annex I, Article 30).

Who is responsible?

The foreign worker applies for the extension to the National Migration Directorate (Decree 616/2010, Annex I, Article 12(c); DNM procedures). An employer that sponsors the entry, stay or regularisation of a foreign national must be registered in the National Single Register of Sponsors of Foreign Nationals and provide the guarantee set by the DNM (Annex I, Article 73), and supplies the contract or proof of continued employment and the registration certificates (DNM procedures). No one may give paid work to foreign nationals residing irregularly (Act 25.871, Article 55).

If the deadline passes

A temporary resident must leave the country when the authorised period, including extensions, expires; otherwise Article 61 applies (Act 25.871, Article 25). On finding that a stay is irregular, the National Migration Directorate may order the foreign national to regularise their situation within a peremptory period, failing which expulsion is ordered (Article 61, as worded by Decree 366/2025). Anyone who gives work to foreign nationals residing irregularly is liable to a fine (Articles 55 and 59), without being released from labour obligations towards the worker (Article 56).

The 60-day window is key

The regulations confine the extension request to the 60 days before expiry and allow a late filing, with a surcharge, only within the 30 days after; after that the right to request it lapses (Decree 616/2010, Annex I, Article 12(e) and (f)). The 60-day reminder coincides with the opening of that window.
