Never let an exposed worker's periodic medical exam lapse
Workers in Argentina exposed to the risk agents in Decree 658/96 must have periodic medical exams at the frequencies in Annex II of SRT Resolution 37/2010, including a yearly clinical exam; some are six-monthly (Article 3(2)). They are the responsibility of the ART or the self-insured employer (Article 3(3)).
Resolution 37/2010 of the Superintendency of Occupational Risks (SRT) sets out the health examinations of Argentina's occupational risk system: pre-employment, periodic, before a transfer of activity, after a prolonged absence and on leaving (Article 1). Periodic exams aim to detect early the conditions caused by the risk agents of Decree 658/96 to which the worker is exposed through their tasks, to prevent occupational diseases (Article 3(1)).
They are mandatory whenever there is exposure to those agents, at the frequencies and with the minimum content of Annex II, including a yearly clinical exam (Article 3(2)). Annex II sets a six-monthly or yearly frequency depending on the agent: six-monthly, for example, for lead, benzene or ionising radiation, and yearly for noise, vibration, silica, biological risks and forced postures and repetitive movements; for some agents the chest X-ray is every two years (Annex II).
The periodic exam is the responsibility of the workers' compensation insurer (ART) or the self-insured employer, although the ART may agree with the employer that the employer carries it out (Article 3(3)). An affiliated employer must give its ART the list of workers exposed to each agent on joining or renewing the contract; the ART has 45 days to notify the centres and times, and the employer has at most 90 days to authorise attendance, without altering the frequency (Article 3(5)).
At a glance
| Minimum frequency | Yearly clinical exam, plus the Annex II tests for the agent (Article 3(2)) |
|---|---|
| Chemical agents | Six-monthly (e.g. lead, mercury, benzene, toluene) or yearly (arsenic, silica, asbestos, carbon monoxide, among others) (Annex II) |
| Physical agents | Six-monthly for ionising radiation; yearly for noise, vibration, non-ionising radiation, voice overload and insufficient lighting (Annex II) |
| Biological and ergonomic agents | Yearly: brucellosis and tuberculosis; forced postures and repetitive movements (Annex II) |
| Noise: susceptibility audiometry | 6 months after the start of employment, by the ART; the employer first reports the worker's name (Article 3(4)) |
| Responsible | ART or self-insured employer; the ART may agree with the employer to carry it out (Article 3(3)) |
| Where | At centres licensed by the health authority, under the responsibility of an occupational physician (Article 8) |
The Annex II tests are mandatory minimums; they may be replaced by equivalent tests of equal or greater sensitivity and specificity, after a reasoned submission to the SRT (Article 11(1) to (3)). The risk agents are those set by Decree 658/96 (Article 3(1)).
Who is responsible?
The periodic exam is the responsibility of the ART or the self-insured employer, although the ART may agree with the employer to carry it out (Article 3(3)); the responsible party bears the cost unless another payment arrangement is agreed (Article 12). The affiliated employer supplies the list of exposed workers and authorises attendance within the deadline (Article 3(5)). The worker must undergo the exams, has the right to know the results and obtain a copy, and must declare their medical history under oath (Article 7).
If the deadline passes
Non-compliance by ARTs and employers with the obligations in the resolution is judged and established under the procedure of SRT Resolutions 10/1997 and 25/1997 and is liable to the penalties in current regulations (Article 9). Those responsible must also give the SRT's medical auditors access to the results (Article 10).
Change of tasks: prior exam
When a change of tasks means the start of possible exposure to one or more risk agents unrelated to the previous tasks, the exam before the transfer of activity is mandatory, takes place before the actual change and is the employer's responsibility, with the minimum content of Annex II (Article 4(2) and (3)). If the change ends the exposure, the exam is optional (Article 4(4)).
