Do not miss the end of a temporary worker supply contract
In Türkiye a temporary worker supply contract lasts as long as the point (a) situation continues, has no limit in seasonal agriculture and domestic services, and otherwise runs up to four months, renewable twice up to eight months (Labour Law No. 4857, Article 7). Work past the term creates an open-ended contract.
Under Türkiye's Labour Law No. 4857, a temporary worker supply contract may be made for as long as the situation lasts in the cases in point (a), such as the worker's military service or suspension of the employment contract; without a time limit in seasonal agricultural work and domestic services; and for up to four months in the other cases. Except for periodic increases in work other than seasonal work, it can be renewed at most twice, up to eight months in total. After that, temporary workers may not be used for the same job until six months have passed (Article 7).
The contract between the private employment agency and the user employer is made in writing and states its start and end dates, the nature of the work, the agency's service fee and any special obligations of the parties (Article 7). If the temporary employment continues after the term in the contract, an open-ended employment contract is deemed to exist between the user employer and the worker from the end date (Article 7; Private Employment Agencies Regulation, Article 11(1)).

In case of an unforeseen increase in capacity (Article 7(2)(f)), temporary workers may not exceed a quarter of the workforce; workplaces with ten or fewer workers may use up to five. A user employer may not take back as a temporary worker someone whose employment contract it terminated until six months after the termination (Article 7).
Who is responsible?
In a temporary employment relationship, the employer is the private employment agency (Article 7). The Law also fines the employer that uses temporary workers in breach of Article 7 (Article 99(1)(b)), and not observing the time limits in Article 7 is a ground for cancelling the agency's temporary employment authorisation (Law No. 4904, Article 18; Regulation, Article 28(1)(d)).
If the deadline passes
An employer or employer's representative using temporary workers in breach of the principles and obligations in Article 7 is fined for each worker (Law No. 4857, Article 99(1)(b)). If breaches of the time limits are found three times under the same ground or six times across grounds within two years, the agency's temporary employment authorisation is cancelled and none is granted for three years (Law No. 4904, Article 18; Regulation, Article 28(1)). After cancellation, ongoing contracts run to the end of their terms, but the agency may not extend them (Law, Article 18; Regulation, Article 28(3)).
