Keep your temporary work agency's guarantee from falling out of date
Temporary work agencies in Argentina post a principal guarantee fixed in UVA units and an accessory one scaled to their workforce, valid for at least twelve months (Law 24.013, Article 78; Decree 407/2026, Annex II, Article 10). Both are adjusted every twelve months; if not, the licence may be cancelled (Article 11).
Law 24.013 requires temporary work agencies (Empresas de Servicios Eventuales, ESE) to post a cash or securities deposit plus a surety or real guarantee, with amounts and conditions set by regulation (Article 78). Decree 407/2026, published in the Official Gazette on 1 June 2026, approved the new Regulation of Temporary Work Agencies as its Annex II (Article 2) and repealed Decree 1694/06 (Article 22); it entered into force on the day of publication (Article 23).
On registering with the Secretariat of Labour, Employment and Social Security, the agency must post a principal guarantee and an accessory guarantee. The principal guarantee is a fixed amount expressed in Unidades de Valor Adquisitivo (UVA), the same for every agency; the accessory guarantee depends on the number of temporary workers actually employed, on a progressive scale by bands. Both may be posted as a UVA-indexed cash deposit, a deposit of national public securities, a real guarantee, a bank guarantee or a surety insurance policy; every instrument must be payable on first demand and valid for at least twelve months (Annex II, Article 10).
The amount of both guarantees is adjusted every twelve months from the date they were originally posted, based on the number of temporary workers at the time of adjustment, shown by sworn statement, on the basis of the previous financial year's monthly average and the UVA value. If during the year the workforce exceeds the declared band's threshold by more than twenty-five per cent, the agency must report this within thirty calendar days and raise the accessory guarantee (Article 10). If the guarantee is not adjusted in time, the authority orders compliance within no more than ten days, failing which the agency's operating licence may be cancelled (Article 11).

A national rule. The agency registers once, when it starts operating, through a simple, electronic and free system; it is licensed fifteen working days after applying if no objections were raised, and must keep the declared information current (Annex II, Art. 9). The UVA amounts are not reproduced on this page.
Who is responsible?
The temporary work agency posts the guarantees on registration and adjusts them every twelve months; it may post them directly or through a third party, which can never be a user company that hires or has hired its services (Decree 407/2026, Annex II, Art. 10). It may replace the instrument with another permitted one, provided the replacement is in place and valid before the previous one is released (Art. 10). The Secretariat of Labour, Employment and Social Security is the competent authority for licensing, cancelling and supervising agencies (Art. 16).
If the deadline passes
If the agency does not adjust the guarantee within the set period, the enforcing authority orders it to comply within no more than ten days, under warning of cancelling its operating licence. Once that period passes without the new guarantee instruments being filed, the guarantor or insurer must deposit the full sums before the guarantee expires, and if it fails to do so enforcement proceedings may follow (Annex II, Art. 11). If the licence is cancelled as a sanction, the deposit is not returned and is used to pay labour and social security claims (Law 24.013, Art. 80). The Secretariat may also revoke or suspend, on its own motion, the licence of an agency that fails to meet the decree's requirements (Annex II, Art. 9).
A new regime in 2026
Decree 407/2026 repealed Decree 1694/06 (Article 22). Under the new Annex II, registration happens once (Article 9) and the recurring obligation becomes the twelve-monthly adjustment of the guarantees from their original posting (Article 10), on top of the term of each bank guarantee or policy, which must be at least twelve months. If your company's dates were calculated under the old regime, recalculate them from the date the current guarantee was posted.
