Never let your public works contractor qualification go out of date
Companies bidding for Argentine national public works must be registered in SICO-COP, whose qualification lasts 36 months from the closing date of the last balance sheet filed (ONC Disposition 24/2025, Annex I, Article 2). After that without an update it becomes outdated; an earlier update restarts the period.
Decree 105/2025 repealed Article 13 of Law 13,064, which had created the National Register of Public Works Contractors, and Law 22,460 (Articles 1 and 3), and provided that contracting with the National Administration requires registration in the database designed and run by the governing body (Article 4). Until its implementing rules take effect, the previous registration regimes remain in force (Article 7). Decree 206/2025 entrusted the National Procurement Office (ONC) with the Contractor Information System (SICO) (Article 1), including the Public Works Contractors category (SICO-COP) for those taking part in procedures governed by Law 13,064 (Article 2(b)). SICO-COP records contractors' financial capacity and track record and classifies and qualifies them, setting a reference execution capacity without weighing works commitments already taken on, thereby removing the reference contracting capacity (Article 7). Only those registered in SICO-COP may take part in Law 13,064 procedures (Article 10). Until the ONC sets the date on which SICO is fully operational, the previous registration regimes remain in force (Article 19).
ONC Disposition 24/2025, published on 26 May 2025 and in force from the next working day (Article 4), repealed Articles 11, 12 and 13 of the Register's rules approved by ONC Disposition 16/2019 (Article 1) and approved the Methodology for Calculating and the Validity of the Qualification of Public Works Contractors (Article 2). Under its Annex I, the Reference Financial Execution Capacity is the product of the Basic Capacity (the average of the three closed financial years with the highest output, chosen from the last five) and the Enabling Factor, which adds up liquidity, solvency, equity and indebtedness ratios; public and private works, in Argentina or abroad, as contractor or subcontractor, all count, and builders with no track record use the net worth of the last financial year as their base (Article 1). The qualification lasts thirty-six months from the closing date of the last balance sheet filed; the company may file an update whenever it sees fit to increase its capacity and, once verified, the period runs again; once the period has passed without an update, the qualification automatically becomes outdated (Article 2).
ONC General Communication 8/2025 clarifies that the former National Register of Public Works Contractors is replaced by SICO-COP, that the new calculation methodology has applied since 27 May 2025, and that, until SICO is fully operational, the National Register of Contractors and Consulting Firms residually keeps its operation and validity. The rules in ONC Disposition 16/2019 still govern pre-registration on CONTRAT.AR (Annex, Article 3), digital filing of documents through Remote Procedures (Article 5) and the duty to keep the electronic file permanently up to date (Article 7); ONC Disposition 24/2025 replaced the annex listing the documents to file for registration or update (Article 3).

A national regime for procurement by the jurisdictions and entities of the National Administration (Law 24,156, Article 8(a)); provinces and municipalities keep their own registers. The system is in transition: Decree 206/2025 keeps the previous registration regimes in force until the ONC sets the date on which SICO is fully operational (Article 19), and ONC General Communication 8/2025 states that the National Register of Contractors residually keeps operating. Decree 1724/93, the Register's former rules, lost its legal basis with the repeal of Article 13 of Law 13,064; its formal status was not verified.
Who is responsible?
The construction company registered as a Public Works Contractor must keep the information in its electronic file permanently up to date (ONC Disposition 16/2019, Annex, Article 7) and file update documents, including balance sheets, so that the ONC recalculates its capacity before the qualification becomes outdated (ONC Disposition 24/2025, Annex I, Article 2). Filings are made by the firm's Authorised Administrator or its attorney-in-fact, with a tax key, through the Remote Procedures platform (ONC Disposition 16/2019, Annex, Article 5). The governing body is the National Procurement Office (Decree 206/2025, Articles 1 and 9).
If the deadline passes
Once thirty-six months have passed from the closing date of the last balance sheet filed without the documents needed for an update, the qualification automatically becomes outdated (ONC Disposition 24/2025, Annex I, Article 2). Zero or negative net worth is grounds for not reaching registered status in a registration or update procedure (Annex I, Article 1, point vii). Only those registered in SICO-COP and not caught by the disqualifications in Article 28 of Decree 1023/01 and Article 5 of Decree 1169/18 may take part in selection procedures governed by Law 13,064 (Decree 206/2025, Article 10). Tender documents may admit bids where the required capacity exceeds the qualified one in lower-budget works, or with an Additional Reference Execution Capacity Guarantee, only under the conditions in Annex I (Article 1 and Annex IA).
The period runs from the balance sheet date, not from registration
The thirty-six months of validity run from the closing date of the last balance sheet filed, not from the date the ONC approved the qualification (ONC Disposition 24/2025, Annex I, Article 2). A company that files its balance sheet several months after the closing date has already used up part of the period. Filing each new balance sheet as soon as it is certified restarts the period and may increase the reference execution capacity.
Tracking it with ExpirySuite
- Add the company and record as the expiry the closing date of the last balance sheet filed plus 36 months; you can also add the next balance sheet closing date as an update reminder.

- Assign a responsible person, such as the tenders manager; if the qualification becomes outdated, managers get further reminders 3, 7 and 14 days later.
Frequently asked questions
- How long does the qualification last?
- Thirty-six months from the closing date of the last balance sheet filed (ONC Disposition 24/2025, Annex I, Article 2). Before that disposition, the rules in ONC Disposition 16/2019 set eighteen months (Annex, Article 12, now repealed).
- Can it be updated before it expires?
- Yes. The company may file updated documents whenever it sees fit to increase its reference execution capacity; once verified, the thirty-six-month period runs again (ONC Disposition 24/2025, Annex I, Article 2).
- Does the National Register of Contractors still exist?
- Article 13 of Law 13,064, which created it, was repealed by Decree 105/2025 (Article 1), and Decree 206/2025 replaces it with the SICO-COP category of the Contractor Information System (Article 2(b)). Until the ONC sets the date on which SICO is fully operational, the previous registration regimes remain in force (Decree 206/2025, Article 19; ONC General Communication 8/2025).
- Which works count as track record?
- All declared works, public or private, carried out in Argentina or abroad, as contractor or subcontractor, as well as labour-supply and equipment-hire contracts in the execution of works; those with no track record use the net worth of the last closed financial year as their base (ONC Disposition 24/2025, Annex I, Article 1).
