Don't miss the annual carcinogenic substances declaration
Employers in Argentina that produce, import, use, sell or give away substances in Annex I of SRT Resolution 81/2019, or covered by its Annex II, must register in the carcinogens surveillance system (Article 5). The sworn statement is filed every year before 1 April, with data for the previous year, through the ART.
SRT Resolution 81/2019 created the Surveillance and Control System for Carcinogenic Substances and Agents (S.V.C.C.) within the Superintendency of Occupational Risks (Article 1), approved the List of Carcinogenic Substances and Agents (Annex I) and the Procedure for reporting their presence (Annex II). It applies from the first working day of 2020 (Article 16) and repealed, among others, SRT Resolution 415/2002 on the former Register of Carcinogenic Substances and Agents (Article 15).
Registration in the S.V.C.C. is mandatory for all employers whose establishments produce, import, use, obtain in intermediate processes, sell or give away free of charge the substances or agents in Annex I, and for those covered by Annex II because of their production processes, economic activities or environmental circumstances (Article 5). Registration is made through the Occupational Risk Insurer (A.R.T.) holding a current contract (Article 6); self-insured employers register directly with the SRT (Article 8).
The filing is a sworn statement and must be made every year before 1 April, with information for the previous calendar year (Annex II, section 2). Employers or their health and safety officers enter the data in the electronic system that the A.R.T. or self-insured employer must maintain (Article 7). Employers must also keep the medical records of potentially exposed workers for forty years after they stop working (Article 11).

A national rule published in the Official Gazette of 10 October 2019. The Prevention Department may amend Annex II and the Systems Sub-department regulates the data structures (Arts. 12 and 13; SRT Systems Sub-department Provision 1/2020). For 2020 the deadline was extended to 30 June 2020 (SRT Provision 1/2020, Art. 7).
Who is responsible?
The employer covered by Article 5, or its health and safety officer, enters the data as a sworn statement in its A.R.T.'s system (SRT Resolution 81/2019, Arts. 6 and 7). The A.R.T. must advise its members and forward the information to the SRT within forty calendar days of receipt (Annex II, sections 3.1 and 3.2). Self-insured employers register directly with the SRT (Art. 8).
If the deadline passes
If an employer that should have registered did not, for example because it was registered in an earlier period and failed to file the next year, the A.R.T. must serve notice within ten calendar days of detecting it, giving no more than twenty calendar days to register; if it still does not, the A.R.T. reports the breach to the SRT within five days (Annex II, section 3.3). Employer breaches are penalised under Annex II of the Federal Labour Pact, ratified by Law 25.212 (Art. 9), which is not reproduced on this page.
A fixed date, not twelve months from the last filing
The declaration does not expire twelve months after the previous filing: it is due every year before 1 April and always covers the previous calendar year (SRT Resolution 81/2019, Annex II, section 2). Set 31 March as the expiry date each year, even if the last filing was made in January or in March.
Tracking it with ExpirySuite
- Add each employer or tax ID (CUIT) in scope and record 31 March of each year as the expiry date; if it is a self-insured employer, note it so you know the filing goes straight to the SRT.
- Email reminders arrive 60, 30, 14, 7 and 1 day before expiry and on the expiry day, leaving time to gather the previous calendar year's data.
- The health and safety officer can upload proof of filing in the A.R.T.'s system through a secure link that is valid for 14 days and needs no account.
- Assign a responsible person, such as the health and safety service; if the date passes with no proof, managers get further reminders 3, 7 and 14 days later.
