Never let your hazardous waste environmental certificate lapse

Hazardous waste generators, carriers and operators registered under Argentina's Law 24,051 renew their Environmental Certificate every year (Article 5). If waste management is unchanged, automatic renewal is requested online up to 60 days before expiry, while the certificate is valid (Resolution 737/2001, Article 3).

Hazardous Waste Law 24,051 creates the National Register of Hazardous Waste Generators and Operators, in which those responsible for generating, transporting, treating and disposing of such waste must register (Article 4). Once the requirements are met, the enforcing authority grants the Environmental Certificate, which proves approval of the handling, transport, treatment or disposal system and is renewed every year (Article 5). The certificate is required for licensing industries, transport and plants that generate or handle hazardous waste (Article 7). The law applies to waste in places under national jurisdiction, waste to be transported outside the province where it arose, or waste that may affect people or the environment beyond that province (Article 1).

Decree 831/93, which implements the law, provides that the Annual Environmental Certificate covers only the process or system declared. Planned changes must be reported to the enforcing authority at least five working days before they are made, and if the process has not changed, the holder simply states this when renewing (Annex I, Article 5). The authority must decide within ninety calendar days; silence counts as refusal (Article 6). The operations register is filed to apply for the yearly renewal (Article 15), and generators pay the Assessment and Inspection Fee every year (Article 16).

Under Resolution 737/2001, as worded by Resolution 232/2018, holders of a valid certificate may request automatic yearly renewal up to 60 days before expiry, provided their waste management has not changed (Article 3). The certificate is deemed renewed on a sworn statement that there have been no changes in processes, waste, categories, storage, activity or fleet (Resolution 232/2018, Article 4); the certificate being renewed must be valid when the filing starts (Article 5), and the filing is made through the Remote Procedures platform (TAD) (Article 11). Small generators under the Simplified Regime renew by sworn statement within the 30 days before expiry (Resolution 197/2019, Article 4).

The national regime of Law 24,051, applicable in the cases in its Article 1; provinces and the City of Buenos Aires have their own hazardous waste rules, not covered here. Filings are made with the National Register of Hazardous Waste Generators and Operators through TAD; the official pages place them under the Environment area of the Cabinet Office.

Who is responsible?

Hazardous waste generators, transporters and operators listed in the National Register must renew the Annual Environmental Certificate (Law 24,051, Articles 4 and 5; Resolution 737/2001, Article 3). According to the official procedure page, filing through TAD requires a technical representative who co-signs the documents that call for it together with the holder.

If the deadline passes

If renewal is not requested within the automatic renewal period, or if there have been changes, the renewal with changes or out of time procedure must be used, which requires further documents (official procedure page). Breaches of the law, its implementing rules and related rules are punished by a warning, a fine, suspension of registration for thirty days to one year or cancellation of registration, and suspension or cancellation means the activity must stop and the site is closed (Law 24,051, Article 49). Making changes without prior authorisation triggers escalating penalties (Decree 831/93, Annex I, Article 5).

Automatic renewal only with no changes

Automatic renewal requires that waste management has not changed and that the certificate is still valid when the filing starts (Resolution 737/2001, Article 3; Resolution 232/2018, Articles 4 and 5). Any change in processes, waste, storage or fleet requires renewal with changes, which is best started earlier because the authority has ninety calendar days to decide (Decree 831/93, Annex I, Article 6).
