Never file the Article 12 yearly sworn statement late

A registered building administrator in Buenos Aires City files a yearly sworn statement listing the associations they manage (Law 941, Article 12). For the 2025 period the deadline is 30 November 2026; anyone who has not started the filing by then is deemed in breach (Disposition 2615/DGDYPC/26, Article 4).

Law 941 of the Autonomous City of Buenos Aires requires administrators listed in the Public Register of Administrators of Condominium Associations to file a yearly report with the status of a sworn statement, containing the updated list of the associations they manage (stating whether paid or unpaid), copies of the meeting minutes on the rendering of accounts, details of payments of pension and social security contributions, workplace risk insurance and union dues for each association's building staff, details of payments for legally required maintenance and inspections, and a sworn statement of assets approved by the association, which may be replaced by professional liability insurance (Article 12). Unpaid volunteer administrators are exempt (Article 12, last paragraph).

The Directorate-General for Consumer Defence and Protection, the enforcing authority (Decree 551/2010, Article 4), sets the deadlines each year by disposition and splits the obligation into two stages. Under Disposition 2615/DGDYPC/26, published on 10 April 2026, the first stage is the Yearly Registration Update, filed by the date shown on the last certificate issued by the Register (Article 2). The second is the Sworn Statement of Managed Associations: those who practised in the 2025 period must file it by 30 November 2026 inclusive, and a certificate is issued for each association declared (Article 3). Both filings are made through the Remote Procedures system, following the instructions approved as Annex I (Article 1). For the previous period, Disposition 882/DGDYPC/25 had set a window from 1 March to 30 November 2025 (Article 3).

Anyone who has not started the filing within the Article 3 deadline is deemed in breach of Article 12 of Law 941 and Article 12 of Decree 551/2010, under Article 15(f) of the law (Disposition 2615/DGDYPC/26, Article 4). The data and supporting documents may be checked (Article 5), and the administrator must display in the entrance hall of each building the certificate for the declared association and make the updated registration certificate available to owners (Article 6). In addition, since Disposition 1129/DGDYPC/26, each new association taken on must be declared under oath within 30 days of the meeting appointing the administrator, and each one dropped within 30 days of resignation or removal (Article 1).

The 30 November 2026 date applies only to the 2025 period: the Directorate sets the deadlines each year by disposition, and for the 2024 period the original deadline was later extended by another disposition. Who is responsible?

The administrator listed in the Public Register of Administrators of Condominium Associations must file the yearly sworn statement for each association managed and the yearly registration update (Law 941, Article 12; Disposition 2615/DGDYPC/26, Articles 2 and 3), and must declare associations taken on or dropped (Disposition 1129/DGDYPC/26, Article 1). Unpaid volunteer administrators are exempt from Article 12 (Law 941, Article 12). The enforcing authority is the Directorate-General for Consumer Defence and Protection (Decree 551/2010, Article 4).

If the deadline passes

Once the Article 3 deadline has passed, an administrator who has not started the filing is deemed in breach of Article 12 of Law 941 and Article 12 of Decree 551/2010 (Disposition 2615/DGDYPC/26, Article 4). Breaching Article 12 is an offence under Article 15(f) of Law 941, punishable by a warning, a fine, suspension from the Register for up to nine months or removal from the Register; the fine may be combined with suspension or removal, and a repeat offence within two years is an aggravating factor (Article 16). Failing to declare an association taken on or dropped also triggers the Article 16 penalties (Disposition 1129/DGDYPC/26, Article 1).

Two different deadlines in one procedure

The yearly registration update falls due on the date shown on the Register's last certificate, which is specific to each administrator, while the sworn statement of associations has a common date set each year by disposition: 30 November 2026 for the 2025 period (Disposition 2615/DGDYPC/26, Articles 2 and 3). Record both dates separately and update the second when the disposition for the next period is published.

  4. Assign a responsible person, such as the head of the management firm; if a deadline passes, managers get further reminders 3, 7 and 14 days later.

Frequently asked questions

What does the yearly sworn statement contain?
The updated list of managed associations (stating whether paid or unpaid), copies of meeting minutes on the rendering of accounts, details of payments of pension and social security contributions, workplace risk insurance and union dues for each association's staff, details of payments for mandatory maintenance and inspections, and a sworn statement of assets approved by the association, replaceable by professional liability insurance (Law 941, Article 12).
By when is the 2025-period statement due?
By 30 November 2026 inclusive, for administrators who practised in 2025; a certificate is issued for each association declared (Disposition 2615/DGDYPC/26, Article 3). The deadline is set each year by the Directorate-General for Consumer Defence and Protection.
What happens if it is filed late?
Anyone who has not started the filing when the deadline ends is deemed in breach of Article 12 of Law 941 and Article 12 of Decree 551/2010 (Disposition 2615/DGDYPC/26, Article 4), an offence under Article 15(f) punishable by a warning, a fine, suspension for up to nine months or removal from the Register (Article 16).
Do volunteer administrators also file?
No. Law 941 exempts unpaid volunteer administrators from the Article 12 obligations (Article 12, last paragraph), and Disposition 2615/DGDYPC/26 restates this in its recitals. They must, however, be listed in the Register (Article 2).
Must each new association be reported during the year?
Yes. Since Disposition 1129/DGDYPC/26, each association taken on is declared under oath within 30 days of the meeting appointing the administrator, and each one dropped within 30 days of resignation or removal (Article 1).
