Never let your plant's Environmental Fitness Certificate expire unrenewed
In Buenos Aires Province every industrial establishment needs an Environmental Fitness Certificate (CAA), valid for four years (Law 11,459, Articles 3 and 11). Renewal starts within the 60 calendar days before expiry and extends the existing certificate for another four years (Decree 531/19, Annex, Article 11).
Law 11,459 of Buenos Aires Province applies to all industries installed or being installed, expanded or modified in the Province (Article 1). Every industrial establishment must hold an Environmental Fitness Certificate (CAA) as an essential requirement for the municipality to grant its industrial licence; the certificate is issued by the enforcing authority for third-category establishments and by the municipality itself for first and second category (Article 3). As worded by Law 15,107, the CAA is valid for four years, its issue comprises three phases (classification of the environmental complexity level, authorisation of the works and authorisation to operate), and the enforcing authority sets how it is renewed before it lapses (Article 11). Expansions, modifications or changes to buildings, premises or installations require applying for the CAA beforehand (Article 10).
Decree 531/19, which implements the law, as amended by Decree 973/20, provides that renewal of the CAA must be started within the sixty calendar days before the certificate granted loses validity, and implies that the establishment has not altered its environmental complexity level or changed its main processes; the enforcing authority or the municipality require the applicant to confirm this and set a simplified renewal process. A renewal does not issue a new CAA: it extends the validity of the one already obtained (Annex, Article 11). If unmet adjustments or changes to installations or processes are found, a reclassification must be started; every successful reclassification grants a new CAA for another four years (Annex, Article 11). The CAA of an industrial park or grouping, by contrast, needs no renewal (Annex, Article 4).
The renewal procedure approved by OPDS Resolution 494/19 (Annex II) is handled through the provincial web portal by the holder, an attorney-in-fact or a professional listed in the RUPAYAR register, for third-category establishments, second-category ones with a municipal agreement, or those located in provincial jurisdiction; the user must hold a CAA that was granted, whether valid or expired, must have started renewal of the related procedures before the Water Authority and the environmental agency, and must start the procedure within the sixty calendar days before expiry, with no filing accepted earlier (point 3). With acceptable results, the CAA's validity is extended for a new four-year period by resolution, recorded in the Environmental Register of Industrial Establishments (point 4.1).

A Buenos Aires Province rule; Buenos Aires City and the other provinces have their own regimes. Law 11,459 as in the text updated by Laws 12,677, 14,199, 14,333, 14,440 and 15,107; Decree 531/19 as worded with Decree 973/20. The enforcing authority named in Decree 531/19 was the Provincial Agency for Sustainable Development (OPDS), whose functions are now exercised by the provincial Ministry of Environment. The national hazardous waste Annual Environmental Certificate (Law 24,051) is a different procedure, covered in another guide.
Who is responsible?
The owner of the industrial establishment must obtain the CAA and renew it before it lapses (Law 11,459, Articles 3 and 11); all filings have the status of a sworn statement, and the technicians and attorneys-in-fact who submit information are jointly liable for its accuracy (Decree 531/19, Annex, Article 5). The renewal procedure may be started by the holder, an attorney-in-fact or a professional listed in the Register of Environmental Professionals and Relationship Administrators (RUPAYAR) (OPDS Resolution 494/19, Annex II, point 3). First- and second-category establishments renew with their municipality, unless a delegation agreement transfers this to the Province (Law 11,459, Article 3; Decree 531/19, Annex, Article 3).
If the deadline passes
Operating establishments without a CAA or with an expired CAA are deemed to be operating irregularly and are subject to the measures in the law (Law 11,459, Article 11). Failing to obtain or renew the CAA in time allows preventive closure, total or partial (Decree 531/19, Annex, Article 20), and a formal breach that prevents operation for lack of an environmental licence or renewal in time counts as a serious offence (Annex, Article 18). Breaches of the law are punished by a warning, a fine or closure (Law 11,459, Article 17), and preventive closure applies when the establishment lacks the certificate (Article 20). Renewal is refused and the file closed if documents or payments are missing, there are closures or unpaid fines, changes requiring reclassification are found, or monitoring gives invalidating results (OPDS Resolution 494/19, Annex II, point 4.2).
The renewal window is short and does not open early
Renewal can only be started within the sixty calendar days before the CAA expires and is not accepted before then (OPDS Resolution 494/19, Annex II, point 3; Decree 531/19, Annex, Article 11). Before that date, have the related renewals before the Water Authority and the environmental agency under way, and check that no process or installation changes require a reclassification.

Frequently asked questions
- How long is the Environmental Fitness Certificate valid?
- Four years, under Article 11 of Law 11,459 as worded by Law 15,107. Renewal extends validity for another four-year period (OPDS Resolution 494/19, Annex II, point 4.1).
- When does renewal start?
- Within the sixty calendar days before the CAA loses validity (Decree 531/19, Annex, Article 11). The procedure approved by OPDS Resolution 494/19 does not accept a start before then (Annex II, point 3).
- What if the plant changed processes or installations?
- Renewal presupposes no change in the environmental complexity level or main processes. If there were changes, a reclassification from Phase 1 must be started before implementing them; every successful reclassification grants a new CAA for another four years (Decree 531/19, Annex, Article 11; Law 11,459, Article 10).
- Who issues the CAA?
- The provincial enforcing authority for third-category establishments and the municipality for first and second category (Law 11,459, Article 3). A municipality may transfer the issue of second-category CAAs to the Province by agreement (Decree 531/19, Annex, Article 3).
