Never let a broker's surety fall below the current required amount
To be licensed in Buenos Aires City, a real estate broker must take out a surety bond in favour of the Brokers' College (Colegio Único de Corredores Inmobiliarios) or post real security (Law 2340, Article 5(4)). The law sets no validity period for the policy: the College sets the required amount every year (Article 6).
Law 2340 of the Autonomous City of Buenos Aires governs real estate brokerage in the City (Article 1) and requires, in order to practise, being qualified under the law and listed in the register (Article 3), which is kept by the Single College of Real Estate Brokers, a non-state public body (Articles 4 and 17). The registration requirements include taking out, in favour of the body in charge of the register, a surety bond or providing the real security set by the implementing rules (Article 5(4)), together with a broker's degree, a legal address in the City, an oath and payment of the sums set by the rules (Article 5).
The surety bond or real security protects users who suffer loss or damage through brokers' activity. The College in charge of the register must determine every year the amount of the surety bond or real security that brokers must hold; both the bond and the real security are earmarked for paying damages caused by the registrant's poor performance and any fines imposed on them. The registrant may choose either option; if they choose real security, it may not be offered as security for any other obligation or be registered as a protected family home, and if it is attached it must be replaced by a similar one within a non-extendable period of ten days (Article 6). Setting the amount of the yearly registration fee and of the surety bond is a function of the College (Article 21(11)), and the Assembly sets the amount and form of the security (Article 25(1)).
The law sets no validity period for the policy: what is renewed yearly is the College's determination of the amount. Unregistered persons may not perform brokerage acts (Article 15) and have no right to demand any fee, nor does anyone disqualified or suspended by the College (Article 16). Registration entails the College's disciplinary power (Article 20), whose Ethics and Discipline Tribunal may impose a private warning, a public reprimand, a fine, suspension of registration for one month to one year, or cancellation, with no re-registration for five years (Articles 42 and 43).

A rule of the Autonomous City of Buenos Aires; it does not apply outside the City. Law 2340 as in the updated text of 29 February 2024, consolidated by Law 6764 (Fifth Update of the Legal Digest); the amendments by Laws 3493 and 5859 do not affect Articles 5 and 6. The implementing rules referred to in Article 5(4) and the College's resolutions setting the amount each year are not published on the City Government's official sites and were not verified for this guide.
Who is responsible?
The registered real estate broker must take out the surety bond in favour of the College or provide the real security, and keep it at the amount the College determines each year (Law 2340, Articles 5(4) and 6). When brokerage is carried out by a company, the registration number of its responsible director or of its members must be shown (Article 10(3)). The Single College of Real Estate Brokers of Buenos Aires City grants and controls registrations and sets the amount of the bond (Articles 18 and 21(11)).
If the deadline passes
If the real security is attached, it must be replaced by a similar one within a non-extendable period of ten days (Law 2340, Article 6). Breaches of the obligations in the law and its rules are subject to disciplinary sanction by the Ethics and Discipline Tribunal: a private warning, a public reprimand, a fine, suspension of registration for one month to one year, or cancellation, after which re-registration cannot be sought for five years (Articles 42 and 43). Anyone suspended or disqualified by the College has no right to collect a fee for brokerage acts (Article 16).
The expiry comes from the policy, not the law
Law 2340 requires the bond or security as a condition of registration and obliges the College to set its amount every year, but does not set the policy's duration (Articles 5 and 6). Record the expiry date shown on the policy taken out and check, at each yearly determination by the College, that the insured sum covers the new amount.
Tracking it with ExpirySuite
- Add each registered broker and record the expiry date shown on their surety bond policy, or the date of the College's next yearly amount determination if they chose real security.
- Email reminders arrive 60, 30, 14, 7 and 1 day before expiry and on the expiry day, leaving time to renew the policy or adjust the sum to the amount set by the College.
- The broker can upload the renewed policy or the proof of security through a secure link that is valid for 14 days and needs no account.
- Assign a responsible person, such as the agency's responsible director; if a policy expires, managers get further reminders 3, 7 and 14 days later.
Frequently asked questions
- Is the surety bond mandatory for registration?
- Yes, or alternatively real security. To be listed in the register, one must take out, in favour of the body in charge of the register, a surety bond or provide the real security set by the implementing rules (Law 2340, Article 5(4)).
- Who sets the amount, and how often?
- The College in charge of the register must determine the amount of the surety bond or real security every year (Law 2340, Article 6); this is one of its functions (Article 21(11)), and the Assembly sets the amount and form (Article 25(1)).
- Does the law set how long the policy lasts?
- No. Law 2340 only requires the amount to be determined each year (Article 6); validity depends on the policy taken out. That is why it is worth recording the policy's expiry date and checking that the sum covers the current yearly amount.
- What does the surety cover?
- It protects users against loss or damage from the broker's activity: the bond or real security is earmarked for paying damages caused by poor brokerage performance and fines imposed on the registrant (Law 2340, Article 6).
