Estate agent liability insurance in Catalonia
To practise in Catalonia, an estate agent must hold and keep in force throughout its activity a civil liability policy covering damage caused in its brokerage work (Article 55.3.d of Catalan Law 18/2007; Article 10 of Catalan Decree 12/2010). It may be collective; lacking it allows cancellation of registration.
This page applies only to estate agents working in Catalonia, Spain. To practise, an agent must take out and keep a permanently valid civil liability policy covering its brokerage activity (Article 55.3.d of Catalan Law 18/2007). Catalan Decree 12/2010 specifies that the policy must cover loss and damage the agent may cause in the course of its activity and remain in force for as long as it works (Article 10).
The insurance can be taken out directly or collectively through professional associations, with insurers established in Spain or another EU state (Article 11). The minimum insured capital is set per claim and per year, and differs for each premises open to the public in Catalonia and for agents working only online (Article 11).
Together with the client-money guarantee (Articles 6 to 9), the insurance is one of the agent's solvency requirements (Article 5). Registration in the Catalan Estate Agents Register shows that the requirements are met, and failing to meet them can lead to cancellation (Articles 18.2 and 21.2).

The estate agent, individual or company, working habitually and for payment in Catalonia (Article 55.1 of Law 18/2007; Article 2.1 of Decree 12/2010). Registered agents must update their data whenever it changes (Article 20.1).
If the deadline passes
Working as an estate agent without meeting the legal requirements is a serious consumer-protection offence (Article 124.2.b of Law 18/2007). Failing to meet the registration requirements leads, after a hearing, to cancellation of the registration (Article 21.2 of Decree 12/2010), and a serious or very serious penalty means temporary removal from the register for the duration of the disqualification (Article 116.1 of the Law).
No fixed legal term
The rules require the policy to be in force for as long as the activity lasts, not for a set term. Record your policy's expiry date; for a collective policy, the association's.
