Never let a Spanish energy certificate expire unnoticed

A Spanish energy performance certificate is valid for at most ten years, reduced to five when the rating is G (Article 13.1 of Royal Decree 390/2021). The owner must renew it under the conditions set by the autonomous community, and the certificate must be registered to be legally valid (Articles 13.2 and 6.6).

Spain's Royal Decree 390/2021 sets the maximum validity of the energy performance certificate (certificado de eficiencia energética) at ten years, except where the energy rating is G: then the maximum validity is five years (Article 13.1). The owner is responsible for renewing or updating it under the conditions set by the autonomous community (Article 13.2 and 13.3).

The certificate is required, among other cases, for new buildings and for existing buildings or parts of buildings that are sold or let to a new tenant (Article 3.1). To be legally valid it must be registered with the competent body of the autonomous community (Article 6.6). If a valid certificate already exists, a new one is not needed (Article 6.1).

The developer or owner commissions the certificate and keeps the documentation (Article 6.1); the owner is responsible for renewing or updating it (Article 13.3). For existing buildings it is signed by a qualified technician (Article 10).

If the deadline passes

Breaches of the decree can be penalised under the twelfth additional provision of the consolidated Land and Urban Rehabilitation Act and, where they are consumer-protection offences, under the consolidated General Act for the Protection of Consumers and Users (Article 21).
