Estate agent client-money guarantee in Catalonia

To practise in Catalonia, an estate agent must take out and keep in force a guarantee, as surety insurance or a bond, covering client money received until it reaches its recipients (Article 55.3.c of Catalan Law 18/2007; Articles 6 and 7 of Catalan Decree 12/2010). It must remain valid for as long as the agent trades.

This page applies only to estate agents working in Catalonia, Spain, whether from premises open to the public or remotely from Catalonia. To practise, an agent must take out and keep a permanently valid guarantee covering the money received in the course of its brokerage until it is passed to the recipients (Article 55.3.c of Catalan Law 18/2007; Article 6.1 of Catalan Decree 12/2010).

The guarantee is a surety insurance or bond with an authorised insurer or financial institution from Spain or another EU state, and it can be taken out directly or collectively through professional associations (Article 7). The minimum amount depends on whether the agent has premises open to the public or works only online, and is set per premises or per agent and year of cover (Article 8).

The guarantee is called on by express agreement between the person who paid the money and its recipient, or by a final court judgment, arbitration award or administrative decision (Article 9). The agent must tell anyone who asks at least the name of the provider and the guarantee's reference number (Article 6.2).

Who is responsible?

The estate agent, individual or company, working habitually and for payment in Catalonia (Article 55.1 of Law 18/2007; Article 2.1 of Decree 12/2010). Registered agents must update their data whenever it changes (Article 20.1).

If the deadline passes

Working as an estate agent without meeting the legal requirements is a serious consumer-protection offence (Article 124.2.b of Law 18/2007). Failing to meet the registration requirements leads, after a hearing, to cancellation of the registration (Article 21.2 of Decree 12/2010), and a serious or very serious penalty means temporary removal from the register for the duration of the disqualification (Article 116.1 of the Law).

No fixed legal term

The rules set no term for the guarantee: it must be in force throughout the activity. The date that matters is the end of the cover period of the policy or bond you have taken out.
