Catalonia habitability certificate: validity and renewal

In Catalonia every home must hold a habitability certificate (cèdula d'habitabilitat), valid 25 years for new homes and 15 years for second-occupation and post-renovation certificates (Article 9.1 of Catalan Decree 141/2012). It is required to occupy a new home, to sell, let or assign use, and to connect utilities.

This page applies only to homes in Catalonia, Spain. Every home must have a habitability certificate (cèdula d'habitabilitat), the administrative act confirming that it meets the minimum habitability conditions and is fit to live in. The certificate is valid for 25 years for newly built homes and for 15 years for second-occupation certificates and first-occupation certificates after renovation (Articles 8.1 and 9.1 of Catalan Decree 141/2012).

New homes, homes whose floor area or habitability conditions change and some renovated homes need the certificate before they are occupied. In other cases, the home must have a certificate when it is sold, let or its use is assigned, so the seller or landlord can hand it over (Article 9.2; Article 26.2 of Catalan Law 18/2007). Electricity, water, gas and telecoms companies require a valid certificate before supplying the home (Article 11).

A second-occupation certificate is applied for online with a habitability certificate signed by a qualified technician (Article 15.1 and 15.3). It is granted by the Catalan Housing Agency or by a town council that has accepted the delegation, and the decision must be notified within 30 working days; without a reply, the application is deemed granted (Articles 13 and 16).

If the deadline passes

Not having the certificate when signing a lease or assignment of use, or when the home is advertised and offered, are minor offences (Article 125.1.c and f of Law 18/2007). Marketing and advertising residential lettings without a certificate is prohibited (Article 59.6). Loss of the minimum conditions leads to revocation of the certificate (Article 18.1 of the Decree).

Lettings in Catalonia

Because the certificate must already exist when a letting is advertised and signed, renew it before looking for a tenant rather than at signing (Articles 59.6 and 125.1 of Law 18/2007).
