Never let a contract review arrive without the vote and the deposit

A collective agreement in Mexico is fully reviewed every two years, approved by the workers' personal, free and secret vote, and deposited with the Federal Centre for Conciliation and Labour Registration (LFT, Articles 399 and 400 Bis). It is requested at least 60 days ahead; otherwise it is extended (Article 400).

The Federal Labour Law sets the rhythm of the full review of a collective bargaining agreement: the review request must be made at least sixty calendar days before the agreement expires, for fixed-term agreements of up to two years, or before two years elapse where the agreement is longer, indefinite or for a specific project; the period is counted as the agreement provides or, failing that, from the date of deposit (Article 399). Independently, cash wages by daily rate may be reviewed every year, with a request at least thirty calendar days before one year has passed since the agreement was signed, reviewed or extended (Article 399 Bis).

Since the reform of 1 May 2019, every two years, at the contract review due under Article 399, the review agreement must be approved by the majority of the workers covered through a personal, free and secret vote under the consultation procedure in Article 390 Ter; reviews are deposited with the Federal Centre for Conciliation and Labour Registration, which may verify that the content was made known to the workers (Article 400 Bis). The review agreement is signed before the competent registration authority, labour court or conciliation centre and takes effect once approved (Article 399 Ter).

The consultation procedure in Article 390 Ter requires the union to notify the Federal Centre in writing or electronically at least ten days in advance, stating the day, time and place and attaching a signed copy of the agreement; to issue the call to vote ten to fifteen days ahead; to make the agreement available to the workers; to keep the employer out of the process; to publish the result within two days; to report the result to the Centre within the following three working days; and to keep the voting records for five years (sections I and II, items a to h). Without majority support, the union may strike or extend the pre-strike period and put the agreement to a new vote (section IV).

If neither party requested the review under Article 399 and no strike was called, the agreement is extended for a period equal to its duration or continues indefinitely (Article 400). As a transitional measure, the 2019 decree ordered that existing collective agreements be reviewed at least once within four years of its entry into force, deposited with the Federal Centre and backed by a majority vote; an agreement that failed the vote or was not put to consultation was deemed terminated, with the workers keeping any benefits above the legal minimum (Eleventh transitory article of the decree, DOF 01-05-2019).

The transitional legitimation of existing agreements (at least one review within four years of the 2019 decree taking effect) is a closed period; since then the permanent rule is Article 400 Bis: consultation and deposit at every two-year review.

Who is responsible?

The union holding the agreement negotiates the review terms with the employer, notifies the Federal Centre, issues the call to vote, runs the ballot and reports the result (Article 390 Ter sections I and II). The employer may not intervene during the consultation (Article 390 Ter section II, item d), but is a party to the agreement and, in practice, the one who must schedule the negotiation with the lead time in Article 399. The Federal Centre for Conciliation and Labour Registration receives the deposit and may verify the consultation (Articles 390 Ter section II item h, and 400 Bis).

If the deadline passes

The law sets no specific fine for omitting the Article 400 Bis consultation; the consequence falls on the agreement itself: without a timely request under Article 399 the agreement is extended (Article 400), and the review agreement takes effect only once approved by the authority before which it is signed (Article 399 Ter). If the Federal Centre finds inconsistencies in substantive facts of the consultation, it declares the vote void and orders it to be repeated (Article 390 Ter section II, item f). During the transitional legitimation, an agreement that was not consulted or lacked majority support was deemed terminated (Eleventh transitory article, decree DOF 01-05-2019).

Count back from the agreement date or the deposit date

Record as the expiry the date on which two years are completed since the agreement was signed, last reviewed or extended, as the agreement provides or, failing that, from the deposit date (Article 399, last paragraph). The review request must be filed at least 60 calendar days earlier (Article 399) and the notice of consultation to the Federal Centre at least 10 days before the vote (Article 390 Ter); the 60- and 30-day reminders cover both milestones. The annual wage review under Article 399 Bis is best recorded as a separate event.

Tracking it with ExpirySuite

  1. Add a record per collective agreement with the date on which two years are completed since signature, last review or extension as the expiry, and a separate annual record for the wage review under Article 399 Bis.
  2. Email reminders arrive 60, 30, 14, 7 and 1 day before the expiry date and on the day; the 60-day reminder matches the minimum lead time for requesting the review.
  3. Labour Relations can upload the deposited agreement and the Federal Centre's receipt through a secure link that is valid for 14 days and needs no account.
  4. Assign the head of Labour Relations as the responsible person; if the date passes without a deposited agreement, managers get further reminders 3, 7 and 14 days later.
