Never let a condominium evacuation plan go more than a year without an update
Every condominium updates its evacuation plan at least once a year, signed by a risk prevention engineer, the chair of the management committee and the administrator (Law 21.442, Article 40; DS 7, Article 34). The updated version is delivered to Carabineros and the fire brigade within 15 calendar days of signature.
Law 21.442, the new Condominium Property Law, published on 13 April 2022, requires every condominium to have an emergency plan for events such as fires, earthquakes or tsunamis, covering the actions to take before, during and after the event, with emphasis on early warning and fire evacuation procedures. The first plan, which must contain the evacuation plan, is signed by the owner of the condominium and filed when applying for final acceptance of the works or, for buildings already accepted, when applying for the certificate under Article 48 (Article 40).
The emergency plan is updated when the general safety conditions, fire safety conditions or the operation of the emergency installations change. The evacuation plan, by contrast, must be updated at least once a year, taking into account the number of residents and especially occupants with disabilities or reduced mobility, infants and non-Spanish speakers, and must include the relevant training and evacuation drills for the different types of emergency. Preparation and updates are carried out and signed by a risk prevention engineer; an update is also signed by the chair of the management committee and the administrator, and the updated plan is delivered in paper and digital form to Carabineros de Chile and the municipality's fire brigade (Article 40).
The law's regulation, Decree 7 of 2023 of the Ministry of Housing and Urban Development, published on 9 January 2025, adds that if circumstances have not changed the committee and the administrator may ask a risk prevention engineer for a reasoned report confirming this; in that case, to meet the annual update, the committee chair, the administrator and the engineer re-sign the plan with the new date and attach the report (Article 34). Updates are delivered to Carabineros and the fire brigade within 15 calendar days of signature, proof of receipt must be requested and, if those bodies raise observations, the corrected version is delivered within 90 calendar days (Article 35).

Emergency and evacuation plans must be prepared and updated in line with the Technical Standard made official by the Ministry of Housing and Urban Development (Law 21.442, fourth transitional article). In condominiums that predate the law and had no emergency plan, the plan must be prepared by a risk prevention engineer and signed by the engineer and the committee chair (DS 7, Article 33). The administrator must report to the Condominium Executive Secretariat, when it so requires, on plan updates and annual drills (Law 21.442, Article 20 No. 11).
Who is responsible?
The management committee updates the emergency plan and delivers updates to Carabineros and the fire brigade (Law 21.442, Article 40; DS 7, Article 35). The committee and the administrator collect the information on each unit, train staff and coordinate drills (DS 7, Article 34). The administrator keeps the documents in the condominium's file (DS 7, Article 35) and provides the updated information requested by the Condominium Executive Secretariat on plan updates and annual drills (Law 21.442, Article 20 No. 11). The committee chair keeps the condominium's document file and hands it to their successor (Article 17).
If the deadline passes
The law provides no grace period: an evacuation plan more than a year without an update breaches Article 40. Failing to provide the information on plan updates and drills requested by the Condominium Executive Secretariat is a less serious breach by the administrator (Law 21.442, Article 87 No. 3 letter a, with Article 20 No. 11), heard by the Regional Ministerial Housing Secretariat on a complaint by the committee or by owners or tenants representing at least 15% of the units (Articles 87, 90 and 91; DS 7, Article 49). The documents must be available at the concierge desk for occupants and the authorities (Article 40).
One plan, two dates: signature and delivery
The annual update is met by the new signature date, but the committee then has 15 calendar days from that signature to deliver the update to Carabineros and the fire brigade and must request proof of receipt (DS 7, Article 35). Record the signature date as the main expiry date and keep the proof of receipt as evidence.
