Reverify Form I-9 before work authorization expires
An employer must reverify an employee's Form I-9 no later than the date the employee's work authorization expires (8 CFR 274a.2(b)(1)(vii)), using Supplement B. If reverification does not take place, the individual may no longer be employed; USCIS suggests reminding employees at least 90 days in advance.
If an employee's employment authorization expires, the employer must reverify on Form I-9 that the employee is still authorized to work in the United States; otherwise the individual may no longer be employed. Reverification must happen not later than the date work authorization expires (8 CFR 274a.2(b)(1)(vii)).
According to USCIS, reverification is needed when the employee's employment authorization or, in most cases, the employment authorization documentation expires. The employer completes one block of Supplement B, Reverification and Rehire (formerly Section 3), and attaches it to the employee's original Form I-9.
The employee must present an unexpired document from List A or List C that shows authorization to work; receipts for a lost, stolen or damaged document are acceptable. USCIS suggests reminding employees at least 90 days before reverification is required.

Who is responsible?
The employer (or a recruiter or referrer for a fee). The employer reviews the document, and if it appears genuine and relates to the employee, records the document's number and expiration date on Form I-9 and signs the attestation.
If the deadline passes
USCIS states that an employer cannot continue employing a person who does not provide proof of current employment authorization. Under 8 CFR 274a.2(b)(1)(vii), if reverification does not take place, the individual may no longer be employed.
Who not to reverify
USCIS says employers should not reverify U.S. citizens and noncitizen nationals, lawful permanent residents who presented a Form I-551 Permanent Resident Card for Section 2 (including conditional residents), or List B documents. Track only the dates that really need reverification.
