Never let a quarter go by without a commission inspection round
In every Mexican workplace, the safety and hygiene commission makes inspection rounds at least quarterly under an annual programme drawn up in the first 30 days of the year, with a report for each round (NOM-019-STPS-2011, points 9.3, 9.5 and 9.12). The employer keeps the evidence for two years (point 12.4).
NOM-019-STPS-2011, Constitution, composition, organisation and operation of safety and hygiene commissions (DOF 13/04/2011), applies throughout Mexico and in every workplace (point 2). The employer must set up at least one commission in the workplace (point 5.1), formalised through a constitution report with the minimum details in point 7.4 (point 7.3). With fewer than 15 workers the commission is made up of one worker and the employer or representative; with 15 or more, a coordinator, a secretary and the agreed number of members (point 7.1).
The employer must have the commission's annual programme of inspection rounds (point 5.5). The programme is drawn up within thirty calendar days of the commission being set up and thereafter within the first thirty calendar days of each year (point 9.3), with priorities based on the areas with most hazardous agents and conditions and on incidents, accidents and occupational diseases (point 9.4).
The inspection rounds in the annual programme must be carried out at least quarterly, to identify hazardous agents, unsafe conditions and unsafe acts, investigate the causes of accidents and diseases, determine preventive measures and follow up their implementation (point 9.5). The commission must also carry out extraordinary inspections within thirty calendar days of an accident causing death or permanent disability, of significant changes to facilities or processes, or of worker reports that warrant it (point 9.9). Follow-up of proposed measures is also at least quarterly (point 9.11).
Each round is recorded in a report containing the details in point 9.12: workplace, address, number of workers, type of round (ordinary or extraordinary), start and end dates and times, areas inspected, agents and conditions identified, causes of accidents, preventive measures, recommendations with their priority, follow-up of earlier ones, place and date, and the names and signatures of the participating members. The employer must hold these reports (point 5.6) and act on and follow up the proposed measures (point 5.11).

| Record keeping | Two years, on paper or electronically (point 12.4) |
The commission's secretary keeps copies of the constitution report and its updates, of the inspection reports for the current and previous year, and of the training evidence for those same periods (point 8.3(i)). A favourable report from a verification unit is valid for two years (point 11.4).
Who is responsible?
The employer sets up the commission, appoints its representatives and asks the union or the workers to appoint theirs (points 5.1 to 5.3), holds the constitution report, the annual programme and the inspection reports (points 5.4 to 5.6), makes it possible for members to perform their duties (point 5.7) and trains them at least once a year (point 5.13). The coordinator draws up the annual programme, presents it to the employer and prepares the report with the secretary at the end of each round (point 8.2(d) and (g)). The secretary calls members to the scheduled rounds, collects signatures and keeps the documentation (point 8.3). Members take part in the rounds and review the reports (point 8.4).
If the deadline passes
Enforcement of NOM-019-STPS-2011 is the responsibility of the Ministry of Labour and Social Welfare (STPS) (point 13.1). In the conformity assessment, the employer complies by presenting the annual programme drawn up within the deadlines in point 9.3 and evidence that rounds are carried out at least quarterly (point 12.3, criterion for points 5.5 and 9.3 to 9.5), as well as the inspection reports (criterion for points 5.6 and 9.12). Employers must comply with the official standards on occupational safety and health (Federal Labour Law, Article 132, section XVII), and there are sanctions for employers who do not observe safety and hygiene standards (Federal Labour Law, Articles 992 and 994, section V).
Three months from the last ordinary round
The standard sets a minimum quarterly frequency for the rounds in the annual programme (point 9.5): record the completion date of the last ordinary round, which appears in the report (point 9.12(l)), plus three months as the expiry. Extraordinary inspections under point 9.9 do not replace the ordinary calendar and are best recorded as separate events. The annual programme has its own deadline: the first thirty calendar days of each year (point 9.3).
