Never leave the minimum standards self-assessment to the last minute
Every December Colombian employers apply the SG-SST minimum standards self-assessment, draw up the improvement plan and the next year's annual plan (Article 26 of Resolución 0312 de 2019). The employer and the SG-SST lead sign the form; non-compliance is punished under Article 36 of the same resolution.
Resolución 0312 de 2019 of Colombia's Ministry of Labour sets the Minimum Standards of the Occupational Safety and Health Management System (SG-SST): the set of rules, requirements and procedures that employers and contracting parties must comply with (Article 1). It applies to public and private employers, to those contracting staff under civil, commercial or administrative contracts, to solidarity-economy and cooperative organisations, to temporary staffing agencies and to occupational risk insurers (ARL), among others (Article 2). It repealed Resolución 1111 de 2017 (Article 37).
From January 2020 every SG-SST runs on an annual cycle from January to December, or for the remaining fraction of the year if the company is created during the year. From 2020 onwards, in the month of December companies must: (1) run the self-assessment against the Table of Values and Scoring of the Minimum Standards, filling in the form in Article 27; (2) draw up the improvement plan based on the result, which must be approved within the Annual SG-SST Plan; and (3) draw up the Annual SG-SST Plan, which starts on 1 January of the following year. The completed form and the improvement plans are registered in the application on the Ministry of Labour's website (Article 26).
The score decides the next step: below 60% (critical) the company must draw up an improvement plan immediately and send a progress report to its ARL within three (3) months at most; between 60% and 85% (moderately acceptable), draw up the improvement plan and send the progress report to the ARL within six (6) months at most; above 85% (acceptable), keep the score and the evidence available to the Ministry and include the improvements in the Annual Work Plan. The improvement plan is sent to the ARL by email or on paper, and the employer must report on its progress in July each year (Article 28). Since December 2019 companies send a copy of the self-assessment and the plan to their ARL (Article 28, paragraph 1).

Who is responsible?
The employer or contracting party: it must meet all the SG-SST Minimum Standards (Article 23 of Resolución 0312 de 2019) and signs the self-assessment form together with the person responsible for running the SG-SST (Article 27). Under Decreto 1072 de 2015, the person in charge of the SG-SST must evaluate it at least once (1) a year (Article 2.2.4.6.8(10.1)).
If the deadline passes
Non-compliance with Resolución 0312 de 2019 is punished under Article 91 of Decreto 1295 de 1994, as amended by Article 13 of Ley 1562 de 2012, together with Decreto 1072 de 2015 (Article 36 of the Resolution). Under Articles 8 and 11 of Ley 1610 de 2013, the workplace may be closed temporarily or permanently where conditions endanger workers' life, integrity and safety (Article 36, paragraph 1). Article 13 of Ley 1562 de 2012 provides for graduated fines for breaches of occupational health rules and, in case of repeat offences, suspension of activities for up to one hundred and twenty (120) days or permanent closure of the company.
Do not confuse the annual self-assessment with the initial evaluation
Decreto 1072 de 2015 also requires an initial evaluation of the SG-SST to identify priorities and set the annual work plan; that self-assessment must be carried out by qualified staff and include the minimum standards that are regulated (Article 2.2.4.6.16). The December self-assessment under Resolución 0312 de 2019 is the one repeated every year (Article 26).
Tracking it with ExpirySuite
- Add the company (or each site or workplace, if you manage them separately) as a record and enter as the expiry date the day in December by which your company closes the self-assessment and improvement plan; the rule sets the month of December, not a specific day (Article 26).
- Email reminders arrive 60, 30, 14, 7 and 1 day before and on the day, leaving time to gather the evidence, fill in the form and register it in the Ministry of Labour's application.
- The SG-SST lead can upload the completed form and the improvement plan through a secure link that is valid for 14 days and needs no account.
- Assign the SG-SST lead as the responsible person; if the deadline passes, managers get further reminders 3, 7 and 14 days later. If you wish, create a second record expiring in July for the improvement plan progress report (Article 28).
