Don't let your RUP lapse by renewing it late

Anyone in Colombia's Single Bidders Register (RUP) must file the renewal information by the fifth business day of April each year (Article 2.2.1.1.1.5.1 of Decreto 1082 de 2015). Otherwise the RUP stops having effect and the bidder is kept out of public procurement until the registration is restored.

Natural and legal persons, Colombian or foreign, domiciled in Colombia and interested in taking part in procurement processes called by state entities must be registered in the Single Bidders Register (RUP), except for the exceptions listed exhaustively in the law (Article 2.2.1.1.1.5.1 of Decreto 1082 de 2015). The application may be filed with any chamber of commerce in the country, but the chamber of commerce of the applicant's domicile is responsible for the registration, renewal or update (Article 2.2.1.1.1.5.2).

The registered party must submit the information to renew its registration no later than the fifth business day of April each year; otherwise the RUP stops having effect. Information on experience and legal capacity may be updated at any time, and the registered party may ask for its registration to be cancelled at any time (Article 2.2.1.1.1.5.1). Bidders whose financial year ends on a date other than 31 December must update their financial information on that date, without prejudice to the obligation to renew the RUP within the general deadline (Article 2.2.1.1.1.5.2).

The chambers of commerce check that the information in the registration, renewal or update form matches the documents filed and then register it; the registration may be challenged by a request for reconsideration (Article 2.2.1.1.1.5.4). The RUP certificate lists the goods, works and services for which the bidder is registered, the qualifying requirements and indicators, information on contracts, fines, sanctions and disqualifications, and the registered experience; state entities can consult it online free of charge (Article 2.2.1.1.1.5.6). Sanctions and disqualifications stay on the certificate for their duration, and fines for one year from publication (Article 2.2.1.1.1.5.7).

Who is responsible?

The registered bidder. For legal persons, the information for registration or renewal includes certificates and financial statements signed by the legal representative and by the statutory auditor (revisor fiscal), where the company must have one, or otherwise by the auditor or accountant (Article 2.2.1.1.1.5.2(2) of Decreto 1082 de 2015). Branches of foreign companies file the accounting and financial information of their parent company (Article 2.2.1.1.1.5.2).

If the deadline passes

If the registered party does not submit the renewal information by the fifth business day of April, the RUP stops having effect (Article 2.2.1.1.1.5.1 of Decreto 1082 de 2015). Since RUP registration is mandatory for taking part in state entities' procurement processes, except for the exceptions listed in the law (Article 2.2.1.1.1.5.1), a lapsed RUP keeps the bidder out of those processes until the registration is restored. The RUP subsection of Decreto 1082 does not provide for a fine for late renewal.

One fixed deadline for everyone

The renewal deadline does not depend on when you first registered: it is the fifth business day of April every year (Article 2.2.1.1.1.5.1 of Decreto 1082 de 2015). Because the exact date shifts with the public-holiday calendar, work it out each year and record it early.

Tracking it with ExpirySuite
