Never let a condominium manager's registration lapse

Anyone managing a condominium in Chile must be listed in the National Register of Condominium Managers and renew the criminal-record certificate every year; legal persons also update good standing and articles (Law 21.442, Article 83; DS 5, Article 20). Without that update the manager is no longer entitled to act.

Law 21.442, the new Condominium Property Law, created the National Register of Condominium Managers, which is public, mandatory and free of charge, run by the Ministry of Housing and Urban Development, and in which every natural or legal person carrying on the activity must register (Article 82). Registration is a prerequisite for acting as administrator or sub-administrator, whether paid or unpaid (Article 83), and whoever acts must keep their registration valid (Article 19). Persons convicted of the offences in Titles VIII and IX of Book Two of the Criminal Code may not register; paid administrators must also prove secondary education and a training course or certification of occupational competences (Article 84).

The Register's regulation, Decree 5 of the Ministry of Housing and Urban Development, published on 26 March 2024, entrusts the Register to the Condominium Executive Secretariat, acting through the Regional Ministerial Secretariats (Seremi) (Articles 1 and 2). Registration is requested on the digital platform with the documents listed in Article 10 (unpaid) or Article 11 (paid), including a criminal-record certificate for special purposes no more than 15 days old; the Seremi decides within 20 working days and observations must be remedied within 30 working days (Articles 15 to 18).

To keep the registration valid, natural and legal persons must update the criminal-record certificate for special purposes every year; legal persons must also update each year the certificate of good standing and articles and the identification of the legal representative or partner who meets the requirements. Registered persons may act as managers only while their registration remains valid (Article 20). Registration is evidenced by a certificate of valid registration available on the platform, valid for 60 days from issue (Article 21), and any change in the documents filed must be reported to the Seremi within 10 working days (Article 22).

If the administrator is a legal person, at least one partner or the legal representative must meet the requirements, and the natural person who actually performs the role must be registered in their own right (Law 21.442, Article 84; DS 5, Articles 10 and 11). Unpaid and paid registration are separate classifications and sanctions under one do not affect the other (DS 5, Article 12). The provisional administrator of social housing under Article 68 of the law needs no registration (DS 5, Article 6).

Who is responsible?

The registered natural or legal person is responsible for keeping the registration valid and updating the records each year (Law 21.442, Article 19; DS 5, Article 20), for reporting changes within 10 working days (DS 5, Article 22) and for providing the information requested by the Condominium Executive Secretariat (DS 5, Article 23; Law 21.442, Article 20 No. 11). The management committee, which sets the administrator's remuneration (Article 19), has an interest in requiring the certificate of valid registration when hiring and at each renewal.

If the deadline passes

Acting as administrator after losing any of the qualifying requirements for registration is a very serious breach, punishable by removal from the National Register and/or a fine payable to the Treasury; providing false information on the requirements is likewise very serious (Law 21.442, Articles 87 No. 1 and 88). Failing to report changes in the filed records triggers a sanction procedure by the Seremi (DS 5, Article 22), and failing to provide the information requested by the Executive Secretariat may do so (DS 5, Article 23). Complaints against administrators are heard by the Seremi at the request of the committee or of owners or tenants representing at least 15% of the units (Law 21.442, Articles 90 and 91; DS 7, Article 49).

One annual deadline and one 60-day certificate

The date that keeps the registration alive is the annual update of the criminal-record certificate (and, for legal persons, of good standing and articles). The certificate of valid registration downloaded from the platform lasts only 60 days and serves as proof for the committee or the Seremi; renew it whenever registration must be shown, but point the main reminder at the annual update.

Tracking it with ExpirySuite

  1. Add the administrator or the management company and record as the expiry date the date of the last annual update of records on the Register platform plus one year.
  2. Email reminders arrive 60, 30, 14, 7 and 1 day before expiry and on the expiry day; the 30-day reminder leaves room to request the criminal-record certificate, which must be no more than 15 days old when filed.
  3. The administrator can upload the certificate of valid registration through a secure link that is valid for 14 days and needs no account.
  4. Assign a responsible person, such as the committee chair or the management company's compliance lead; if the date passes, managers get further reminders 3, 7 and 14 days later.
