Never miss your SPCC plan's five-year review
The owner or operator of a facility covered by EPA's oil pollution prevention rule must review and evaluate its SPCC Plan at least once every five years and document the review with a signed statement saying whether the Plan will be amended (40 CFR 112.5(b)). Any amendment the review calls for is due within six months.
EPA's oil pollution prevention rules (40 CFR part 112) apply to owners and operators of non-transportation-related onshore and offshore facilities that store, process, use or otherwise handle oil and could reasonably be expected to discharge oil in harmful quantities into navigable waters or adjoining shorelines (40 CFR 112.1(b)). A facility is exempt if its completely buried oil storage capacity is 42,000 U.S. gallons or less and its aggregate aboveground oil storage capacity is 1,320 U.S. gallons or less, counting only containers of 55 U.S. gallons or more (40 CFR 112.1(d)(2)).
The owner or operator of a covered facility must prepare in writing and implement a Spill Prevention, Control, and Countermeasure (SPCC) Plan (40 CFR 112.3). Except as provided for qualified facilities in 40 CFR 112.6, a licensed Professional Engineer must review and certify the Plan for it to be effective (40 CFR 112.3(d)).
The owner or operator must complete a review and evaluation of the SPCC Plan at least once every five years. If the review finds field-proven prevention and control technology that would significantly reduce the likelihood of a discharge, the Plan must be amended within six months of the review, and the amendment implemented as soon as possible, but not later than six months after it is prepared. The review must be documented with a signed statement saying whether the Plan will be amended (40 CFR 112.5(b)).

Who is responsible?
The owner or operator of the facility. It must keep a complete copy of the Plan at the facility if the facility is normally attended at least four hours a day, otherwise at the nearest field office, and make it available to the EPA Regional Administrator for on-site review during normal working hours (40 CFR 112.3(e)).
Changes at the facility need an amendment too
Apart from the five-year review, the Plan must be amended when a change in facility design, construction, operation or maintenance materially affects its potential for a discharge, such as commissioning or replacing containers, changing piping or secondary containment, or changing the product stored. The amendment must be prepared within six months and implemented within six months after it is prepared (40 CFR 112.5(a)).
