Get the annual senior management review of your SG-SST done and documented

At least once a year, senior management of every Colombian company must review how the SG-SST is working and share the documented results with the COPASST or OSH Monitor and the system lead (Article 2.2.4.6.31 of Decreto 1072 de 2015). There is no grace period; non-compliance is punished under Article 2.2.4.6.36.

Senior management, whatever the size of the company, must carry out a review of the Occupational Safety and Health Management System (SG-SST) at least once (1) a year, in line with changes in processes, audit results and other reports that provide information on how the system is working (Article 2.2.4.6.31 of Decreto 1072 de 2015). The review must determine to what extent the occupational safety and health policy and objectives are met and risks are controlled, and must not be done only reactively on the basis of accident and disease statistics, but proactively, assessing the structure and process of OSH management.

The same article lists twenty-four outcomes the review must enable, including checking the effectiveness of the strategies and compliance with the annual work plan and its schedule, analysing whether resources are sufficient, assessing the need for changes to the system (including the policy and its objectives), analysing indicators and previous audits, demonstrating compliance with current legislation and the applicable minimum standards, keeping the hazard identification and risk assessment up to date, and monitoring working conditions and workers' health. The results must be documented and shared with the COPASST or OSH Monitor (Vigía) and with the person responsible for the SG-SST, who defines and implements the preventive, corrective and improvement actions (paragraph).

The Minimum Standards in Resolución 0312 de 2019 reflect this obligation: for companies with eleven to fifty workers in risk classes I, II or III, the criterion is for senior management to review the results of the SG-SST at least once a year, verified by requesting evidence of that review (Article 9); for companies with more than fifty workers, and those with fifty or fewer in risk classes IV or V, the annual review must cover the system, its results and the scope of the compliance audit under Article 2.2.4.6.30 of Decreto 1072 de 2015, and be communicated to the COPASST and the SG-SST lead (Article 16). In the scoring table it appears as standard 6.1.3, 'Annual review by senior management, results and scope of the audit', with improvement actions arising from that review as standard 7.1.2 (Article 27). The table in Article 3, for companies with ten or fewer workers in risk classes I, II or III, has no specific senior-management-review item, but Article 2.2.4.6.31 of Decreto 1072 de 2015 applies regardless of company size.

Who is responsible?

The obligation lies with the company's senior management, whatever its size (Article 2.2.4.6.31 of Decreto 1072 de 2015). The SG-SST lead receives the results together with the COPASST or OSH Monitor and must define and implement any preventive, corrective and improvement actions (paragraph). ARLs carry out delegated supervision and report non-compliance by their member companies to the Ministry of Labour (Article 2.2.4.6.36, paragraph).

If the deadline passes

Decreto 1072 de 2015 provides no grace period for the annual review. Non-compliance with the SG-SST chapter is punished under Article 91 of Decreto Ley 1295 de 1994, as amended by Article 13 of Ley 1562 de 2012 (Article 2.2.4.6.36), and non-compliance with the Minimum Standards on the same terms, with the possibility of temporary or permanent closure of the workplace under Ley 1610 de 2013 where conditions endanger workers' life, integrity and safety (Article 36 and paragraph 1 of Resolución 0312 de 2019).

Review, audit and self-assessment: three different dates

The senior management review takes the results of the annual compliance audit as an input (Articles 2.2.4.6.29 and 2.2.4.6.31 of Decreto 1072 de 2015) and is separate from the Minimum Standards self-assessment (Resolución 0312 de 2019). Scheduling the audit before the review lets the review analyse its results, as item 7 of Article 2.2.4.6.31 requires.
