Don't miss the annual hazardous-waste register update, under the old date or the new one
The annual update of Colombia's hazardous waste generator register is due by 31 March under Resolución 1362 de 2007 and, in the RUA, by 15 March (tax ID ending 0 to 4) or 30 April (5 to 9) under Article 15 of Resolución 839 de 2023. Breaches trigger the measures of Ley 99 de 1993.
A generator of hazardous waste must register once with the competent environmental authority and keep its registration information updated every year (Article 2.2.6.1.3.1(f) of Decreto 1076 de 2015). Large, medium and small generators must register, that is, anyone generating 10 kg/month or more of hazardous waste, using weighted averages and a six-month moving average; those generating less are exempt unless the environmental authority requires registration (Article 2.2.6.1.6.2). The register is governed by Resolución 1362 de 2007 or the rule that amends or replaces it (Article 2.2.6.1.6.1).
Resolución 1362 de 2007 provides that registered generators update the information reported in the register every year with the environmental authority no later than 31 March (Article 5); the information covers the balance period from 1 January to 31 December of the previous year, and the generator must keep a logbook of monthly quantities per waste stream (Article 4). The procedure takes place before the environmental authority with jurisdiction over each establishment, with a separate registration per establishment or facility (Article 6). Resolución 839 de 2023 of the Ministry of Environment and Sustainable Development provided that Resolución 1362 de 2007 remains in force until 31 December 2025 (Article 2 on entry into force) and that non-manufacturing generators file or update the 2023 and 2024 balance periods using the generator register tool (Article 24(3)).
From then on, generators required to report in the hazardous waste generator register are among those who must file and update the Single Environmental Register (RUA) every year, per establishment (Article 7 of Resolución 839 de 2023). Deadlines depend on the sector and on the last digit of the identification number: for the manufacturing sector, from 2025, between 1 February and 15 March (digits 0 to 4) or between 16 March and 30 April (digits 5 to 9); for all other sectors, the same ranges from 2026, with 2025 as the first balance period and the RUA registration request filed between 1 June and 30 November 2025 depending on the digit (Article 15). The information covers the previous year's balance period and supporting records are kept for five (5) years (Article 13, paragraph 1). Breach of the register's provisions gives rise to the preventive measures and sanctions of Ley 99 de 1993 (Article 12 of Resolución 1362 de 2007).

Who is responsible?
The generator, for each establishment or facility that generates hazardous waste: it requests registration, files the information and updates it before the environmental authority of the jurisdiction where the establishment is located (Article 6 of Resolución 1362 de 2007; Articles 7 and 10 of Resolución 839 de 2023). It must keep the logbook of monthly quantities per waste stream and retain supporting records (Article 4, paragraph 2, of Resolución 1362 de 2007; Article 13 of Resolución 839 de 2023), and electronically signs a sworn statement on the accuracy of the information (Article 14 of Resolución 839 de 2023).
If the deadline passes
Letting the annual window pass breaches the duty to keep the register information updated (Article 2.2.6.1.3.1(f) of Decreto 1076 de 2015). Environmental authorities verify the information and compliance through control and follow-up, and in case of breach impose the preventive measures and sanctions of Ley 99 de 1993 or the rule replacing it (Articles 11 and 12 of Resolución 1362 de 2007). If access to the tool fails for technical reasons attributable to IDEAM in the five business days before the deadline, the establishment must report within five (5) business days after IDEAM announces the tool is restored (Article 12, paragraph 2, of Resolución 839 de 2023).
31 March is no longer the only date
Up to the update for the 2024 balance period, the reference was 31 March (Article 5 of Resolución 1362 de 2007). Under the RUA, the window depends on the last digit of the identification number: it closes on 15 March for digits 0 to 4 and on 30 April for digits 5 to 9 (Article 15 of Resolución 839 de 2023). Check your tax ID's last digit before setting the date.
Tracking it with ExpirySuite
- Add each generating establishment as a record and enter as the expiry date the close of its RUA window next year: 15 March if the last digit of the tax ID is 0 to 4, or 30 April if it is 5 to 9.
- Email reminders arrive 60, 30, 14, 7 and 1 day before and on the day; the 60-day reminder lands in mid-January or early March, depending on the digit, in time to close the previous year's logbook.
- The environmental officer can upload the register submission confirmation through a secure link that is valid for 14 days and needs no account; then move the date to the close of next year's window.
- Assign the environmental management team as responsible; if the date passes without confirmation, managers get further reminders 3, 7 and 14 days later.
