Make sure the EST files its statistical report in each of the four months the rule sets
In January, April, July and October a Colombian temp agency (EST) files with the Labour Ministry's territorial office its statistical report on vacancies, placements and assigned workers (Article 2.2.6.5.15 of Decreto 1072 de 2015). Not filing leads to suspension of the authorisation and, on repetition, cancellation.
A temporary staffing agency (Empresa de Servicios Temporales, EST) is a company that contracts with third-party beneficiaries to collaborate temporarily in their activities through the work of natural persons hired directly by the EST, which is their employer (Article 2.2.6.5.2 of Decreto 1072 de 2015). Among its recurring duties is filing the statistical reports referred to in Article 88 of Ley 50 de 1990.
Those reports must be filed during the months of January, April, July and October of each year with the Ministry of Labour's territorial office (Dirección Territorial) for the EST's main domicile, on the forms drawn up by the Ministry, and must contain information on vacancies, placements and assigned workers (trabajadores en misión) for both the main domicile and the branches. A copy is sent to the territorial offices where branches operate (Article 2.2.6.5.15). The territorial offices record and consolidate this statistical information and use it, among other purposes, to order the adjustment of the guarantee policy according to the previous year's movement of assigned workers (Article 2.2.6.5.19(4) and (7)).
Failing to send the statistical reports in the form and within the terms set by law and by the chapter is a ground for suspending the EST's and its branches' operating authorisation (Article 2.2.6.5.21(2)), and repetition of a suspension ground leads to cancellation of the authorisation (Article 2.2.6.5.22(1)). The annual guarantee policy and the operating authorisation itself are separate obligations with their own rules.

Article 2.2.6.5.15 sets the filing months but no specific day within each month; the report must be filed during the month indicated.
Who is responsible?
The EST, through its legal representative, for the main domicile and all branches: branch information is included in the report filed at the main domicile and a copy is sent to the territorial offices where the branches operate (Article 2.2.6.5.15 of Decreto 1072 de 2015). The territorial offices carry out inspection, surveillance and control of ESTs (Article 2.2.6.5.19(8)).
If the deadline passes
If the EST does not send its statistical reports in the form and within the terms set, the competent territorial office sanctions it with suspension of the operating authorisation, which also covers the branches (Article 2.2.6.5.21(2) of Decreto 1072 de 2015). Repetition of a suspension ground is a cause for cancelling the authorisation (Article 2.2.6.5.22(1)), and if the authorisation stays suspended for more than six (6) consecutive months without the legal representative showing an interest in resuming the service, cancellation also follows (Article 2.2.6.5.22(5)). Without a valid authorisation the EST cannot supply assigned workers.
Four fixed dates, not a period counted from the last filing
The frequency does not depend on when the previous report was filed: it is always January, April, July and October (Article 2.2.6.5.15 of Decreto 1072 de 2015). The January report also closes the previous year, whose movement of assigned workers the territorial office uses to order the guarantee-policy adjustment (Article 2.2.6.5.19(4)).
