Polish periodic OHS training: track the deadline for each group
Periodic OHS training in Poland is due at least every 3 years for manual positions, yearly for particularly dangerous work, every 5 years for managers and every 6 years for office staff (§ 15 of the OHS training regulation). The employer provides it at its own expense (Article 237³ of the Labour Code).
Employers in Poland must train employees in occupational health and safety before they start work and provide periodic training. Training takes place during working hours and at the employer's expense (Article 237³ § 2 and § 3 of the Polish Labour Code).
The intervals are set by the regulation on OHS training. Employees in manual (blue-collar) positions receive periodic training as an instruction session at least every 3 years, and at least once a year where particularly dangerous work is carried out (§ 15(1)). Employers and other people who manage employees, engineering and technical staff, OHS service staff and the other employees listed in § 14(2) point 6 are trained at least every 5 years, and administrative and office staff at least every 6 years (§ 15(2)). The employer sets the frequency and duration for specific positions after consulting employees or their representatives (§ 15(3)).
The first periodic training for people who manage employees takes place within 6 months of starting the job, and for all other groups within 12 months (§ 15(4)). Training ends with an exam, and completion is confirmed by a certificate issued by the training provider; a copy is kept in the personnel file (§ 16).
At a glance
| Group (§ 14(2)) | At least every | First periodic training |
|---|---|---|
| Manual (blue-collar) positions | 3 years (instruction session) | within 12 months |
| Particularly dangerous work | year | within 12 months |
| Employers and people managing employees | 5 years | within 6 months |
| Engineering and technical staff, OHS service, others in point 6 | 5 years | within 12 months |
| Administrative and office positions | 6 years | within 12 months |
Periodic training for administrative and office staff is not required if the employer's main activity is in a group with an accident-insurance risk category no higher than three, unless the risk assessment shows it is necessary (Article 237³ § 2² of the Labour Code).
Who is responsible?
The employer provides the training and must also complete OHS training needed for its own duties, repeated periodically (Article 237³ § 2 and § 2¹ of the Labour Code). Employees must take part in training and instruction and sit the required exams (Article 211 point 1).
If the deadline passes
An employee may not be allowed to work without sufficient knowledge of health and safety rules (Article 237³ § 1). A person responsible for health and safety or managing employees who does not comply with health and safety rules is liable to a fine (Article 283 § 1 of the Labour Code).
New hires: a separate record for the first training
The first periodic training has its own deadline: 6 or 12 months after starting the job (§ 15(4)). When you add a new employee, create a second record with that date. A person can be exempted if they present a current certificate showing that they completed the required periodic training with another employer within that period (§ 15(5)).
