Never let the annual evaluation of the preventive programme slip past a year
Every employer must evaluate compliance with its preventive work programme at least once a year, reviewing the effectiveness of the actions and ordering continuous-improvement measures (DS 44 of 2024, Article 14). The evaluation must be documented and kept available for inspectors (Article 72).
Supreme Decree 44 of 2024 of the Ministry of Labour and Social Security approved the new regulation on preventive management of occupational risks. It was published on 27 July 2024 and, under its first transitional article, applies from the first day of the sixth month after publication, that is, from 1 February 2025. Every employer must implement at its workplaces a hazard identification and risk assessment matrix and a risk management programme that reflect the principle of continuous improvement (Article 4 No. 2).
The preventive work programme is drawn up or amended on the basis of the matrix, within 30 calendar days of the matrix being prepared or updated; it must contain at least the preventive and corrective measures, implementation deadlines and the people responsible, be set out in writing and approved by the legal representative with the date of approval and of any amendments, be communicated to workers and sent in copy to the Joint Health and Safety Committee (Article 8).
The employer must carry out, at least annually, an evaluation of compliance with the preventive work programme; in particular it must assess the effectiveness of the programmed actions and order the continuous-improvement measures required (Article 14). The matrix itself is reviewed at least annually or whenever working conditions change, a work accident occurs, an occupational disease is diagnosed or a serious and imminent risk arises (Article 7). All information on preventive management must be recorded and backed up in documents, available to the enforcement authority and the insurance administrator (Article 72).

Where the employer has a Risk Prevention Department, the expert in charge must propose, implement and control the programme, report monthly in writing on its progress and deliver an annual report evaluating the results of preventive management; workers, their representatives and the Joint Committees have access to those reports (Article 52 No. 15). Employers with up to twenty-five workers apply the simplified management system of Article 64, with technical assistance from their insurance administrator.
Who is responsible?
The obligation rests with the employer (Article 14), which approves the programme through its legal representative (Article 8). Where there is a Risk Prevention Department, the expert in charge proposes and controls the programme and delivers the annual evaluation report (Article 52 No. 15); the Law 16.744 insurance administrator provides technical assistance (Articles 6 and 76).
If the deadline passes
DS 44 sets no deadline other than the annual one and no specific penalty for a missed evaluation: inspection, enforcement and sanction of breaches of the regulation fall to the Regional Ministerial Health Secretariats and the Labour Directorate, within their legal powers, without prejudice to the Superintendency of Social Security (Article 77). Because all preventive management must be documented and available to inspectors (Article 72), an undated evaluation or one more than a year old is the first gap an inspector finds.
Three dates worth tracking separately
The matrix is reviewed at least once a year (Article 7), the programme is adjusted within 30 days of each matrix update (Article 8) and compliance with the programme is evaluated at least annually (Article 14). They are three documents with their own dates; record the date of the last evaluation separately from the matrix review date.
Tracking it with ExpirySuite
- Add the employer, or each site or branch with its own programme, and record as the expiry date the date of the last programme evaluation plus one year.
- Email reminders arrive 60, 30, 14, 7 and 1 day before expiry and on the expiry day; the 60-day reminder leaves time to gather the programme indicators and convene the Joint Committee.
- The prevention expert or internal owner can upload the evaluation minutes or report through a secure link that is valid for 14 days and needs no account.
- Assign a responsible person, such as the head of the Risk Prevention Department; if the date passes, managers get further reminders 3, 7 and 14 days later.
