Never let your MINVU register capital certificate suspend you
A contractor in the MINVU National Contractor Register proves its capital with a bank certificate valid for 16 months from the bank's verification date (Supreme Decree 127 of 1977, Article 16). It must be renewed before expiry with the balance sheet and tax return, or the contractor is suspended from the Register.
Supreme Decree 127 of 1977 of the Ministry of Housing and Urban Planning (MINVU) approves the Regulation of the MINVU National Contractor Register. Only registered contractors may execute works or supply industrialised components for the Ministry, the Housing and Urbanisation Services (SERVIU) and the other bodies related to MINVU (Articles 1 and 2). Registration is classified into categories according to the background, experience and capital proven (Article 7), is processed at the Regional Ministerial Secretariat of the contractor's domicile (Article 19) and, once ratified by the Register's National Coordinator, is valid nationwide (Articles 4 and 24).
The capital required for registration is proven by a bank certificate in the contractor's name stating that the contractor holds a current account and that the bank, after verification, has confirmed the capital available; the Register reserves the right to verify the declared capital directly. Certificates proving capital are valid for 16 months, running from the date on which the bank verified the capital, which must be expressly stated in the certificate. The same rules apply to changes in capital (Article 16).
Contractors, whether individuals or legal entities, must update the bank certificates before that period expires, attaching a certified copy of the balance sheet for the last financial year and of the tax return as at 31 December of the previous year, both valid for 16 months from the end of the period they cover, and commercial background certificates under Article 20, valid for 60 days (Articles 16 and 20). A contractor who fails to do so is automatically suspended from the Register for as long as the cause persists (Article 45, letter m). The current registration certificate issued by the Register states the verified capital and its expiry date and is valid for 60 days (Article 26).

LeyChile records DS 127 of 1977 as in force, with its latest version dating from 6 February 2002; the 16-month rule in Article 16 was introduced by DS 128 of 1994. The Register's categories and the capital amounts per category are set in the regulation itself and in ministerial resolutions (Articles 7 and 32); this guide does not reproduce those amounts.
Who is responsible?
The duty to update the bank certificates before they expire rests with the registered contractor, whether an individual or a legal entity (Article 16). Limited liability companies and corporations prove the company's own capital and may top it up with capital certificates of partners or directors who become joint and several guarantors (Article 17). Changes to boards, senior management, by-laws or deeds are notified to the Register within 10 days (Article 23).
If the deadline passes
Contractors who fail to meet the duty to update the bank certificates under Article 16 are automatically suspended from the Register for as long as the disqualifying cause persists (Article 45, letter m). While suspended they cannot take part in tenders of the institutions that use the Register, since current registration is a condition for executing works for them (Articles 1 and 2) and the available economic capacity for bidding is calculated on the verified capital accredited by the Register (Article 18). The current registration certificate, which states the verified capital and its expiry date, is itself valid for only 60 days (Article 26).
Three documents with different dates
The bank capital certificate is valid 16 months from the bank's verification; the balance sheet and tax return are valid 16 months from the close of the period they cover, so their expiry need not coincide with the certificate's (Article 16); and the commercial background certificates are valid 60 days (Article 20). Record the bank certificate as the main date and plan the renewal of the set with margin, since the bank must verify the capital before issuing the new certificate.
