Keep every school building's 6-month asbestos surveillance on schedule
Under EPA's asbestos-in-schools rule, the local education agency must visually inspect all ACBM or assumed ACBM areas in each school building at least once every 6 months after the management plan is in effect (40 CFR 763.92(b)(1)). No accredited inspector is required and there is no grace period.
At least once every 6 months after a management plan is in effect, each local education agency must conduct periodic surveillance in each building that it leases, owns or otherwise uses as a school building that contains asbestos-containing building material (ACBM) or is assumed to contain it (40 CFR 763.92(b)(1)).
The person doing the surveillance must visually inspect all areas identified in the management plan as ACBM or assumed ACBM, record the date, his or her name and any changes in the condition of the materials, and submit a copy of the record to the agency's designated person for inclusion in the management plan (40 CFR 763.92(b)(2)(i) to (iii)). For each surveillance the agency records the name of each person performing it, the date and any changes in condition (763.94(d)).
Periodic surveillance is the short cycle between the 3-year reinspections by an accredited inspector required by 40 CFR 763.85(b)(1), which are covered in the separate AHERA reinspection guide. Unlike the reinspection, the surveillance is a visual check and the rule does not require the person doing it to be an accredited inspector. Thermal system insulation that has kept its structural integrity and an undamaged protective jacket is treated as nonfriable and is subject only to periodic surveillance and preventive measures as necessary (763.85(c)).

A local education agency includes the owner of any nonpublic, nonprofit elementary or secondary school building (40 CFR 763.83). The management plan must include a plan for periodic surveillance under 763.92 alongside the reinspection and operations and maintenance plans (763.93(e)(9)).
Who is responsible?
The local education agency. It must designate a person to ensure the requirements are properly implemented and make sure that person receives adequate training (40 CFR 763.84(g)), and must ensure that the people who perform periodic surveillance carry it out in accordance with subpart E (763.84(a)).
If the deadline passes
A surveillance more than 6 months after the previous one misses the minimum frequency in 40 CFR 763.92(b)(1). The rule sets no grace period; the agency should carry out the visual inspection as soon as possible, record it and file the record in the management plan, which must be kept current with surveillance activities (763.93(d)).
Who may do the surveillance
Section 763.92(b) requires a visual inspection and a record, but not an accredited inspector, so trained custodial or maintenance staff may do it. Those staff must have the awareness training in 763.92(a)(1), and staff who have attended EPA-approved or equivalent training for operations and maintenance and periodic surveillance are considered trained for that section (763.92(a)(3)). Workers and building occupants, or their legal guardians, must be informed at least once each school year about periodic reinspection and surveillance activities that are planned or in progress (763.84(c)).
Tracking it with ExpirySuite
- Add each school building that contains or is assumed to contain ACBM and record the date of the last periodic surveillance; the next one is due no more than 6 months later.
- Keep the 3-year reinspection as a separate record for the same building, as described in the AHERA reinspection guide, so both cycles are visible.
- Reminders arrive 60, 30, 14, 7 and 1 day before the due date and on the day itself.
- Assign a responsible person (for example the agency's designated person under 763.84(g)) so the right person gets the reminder.
- If a date passes, managers get overdue reminders 3, 7 and 14 days later.
- Ask the person who did the surveillance to upload the dated, signed record through a secure upload link, valid for 14 days; no account is needed, and the record then goes into the management plan.
Frequently asked questions
- How often is periodic surveillance required?
- At least once every 6 months after a management plan is in effect, in each school building that contains or is assumed to contain ACBM (40 CFR 763.92(b)(1)).
- What does the surveillance involve?
- A visual inspection of all areas identified in the management plan as ACBM or assumed ACBM, with the date, the person's name and any changes in the condition of the materials recorded and a copy sent to the designated person (40 CFR 763.92(b)(2)).
- Does it need an accredited inspector?
- Section 763.92(b) does not require one; the 3-year reinspection under 763.85(b) does. See the AHERA reinspection guide for that cycle.
- What must be recorded?
- For each surveillance, the name of each person performing it, the date and any changes in the condition of the materials, kept as part of the management plan (40 CFR 763.94(a) and (d)).
