Keep track of the maximum assignment period for each placement
In Germany the same agency worker may be assigned to the same user company for at most 18 consecutive months; earlier assignments count if no more than three months separate them (Section 1(1b) AÜG). If exceeded, the contract with the agency is void and an employment relationship with the user arises (Sections 9, 10).
Temporary agency work is only permitted temporarily, up to a maximum assignment period (Section 1(1) sentence 4 of the German Temporary Agency Work Act, AÜG). The agency may not assign the same agency worker to the same user company for more than 18 consecutive months, and the user company may not have them work for longer (Section 1(1b) sentence 1). Earlier assignments to the same user company, by the same or another agency, count in full if no more than three months lie between them (sentence 2). Assignment periods before 1 April 2017 do not count (Section 19(2)).
A collective agreement concluded by the parties in the user company's sector can set a different maximum (Section 1(1b) sentence 3). User companies not bound by collective agreements can adopt such a rule within the agreement's scope through a works or service agreement (sentence 4). If a collective agreement allows different rules in a works or service agreement, user companies not bound by it may also use this up to a maximum of 24 months, unless the collective agreement sets a different maximum for such agreements (sentences 5 and 6). Churches and religious communities under public law can set their own maximums (sentence 8).
If the permitted maximum is exceeded, the employment contract between agency and agency worker becomes invalid, unless the worker declares in writing within one month after the maximum is exceeded that they wish to keep it (Section 9(1) no. 1b AÜG). This declaration is only effective if the worker first presents it in person at an employment agency and it reaches the agency or the user company no later than the third day after that (Section 9(2)). Where the contract is invalid, an employment relationship with the user company is deemed to exist from the moment of invalidity (Section 10(1)).

Who is responsible?
The maximum binds both sides: the agency, which may not assign the worker for longer, and the user company, which may not have them work for longer (Section 1(1b) sentence 1 AÜG). The calculation is always per agency worker at the same user company, even across different agencies (sentence 2).
If the deadline passes
An agency that assigns an agency worker for longer than permitted under Section 1(1b) sentence 1 commits an administrative offence (Section 16(1) no. 1e AÜG); the Federal Employment Agency is the competent authority (Section 16(3)). Under civil law, the contract with the agency becomes invalid and an employment relationship with the user company arises unless the worker validly objects (Section 9(1) no. 1b, Section 10(1)).
Not the same as the AÜG licence
The maximum assignment period is a deadline per placement, not per company. The agency work licence and its renewal are a separate matter with their own deadline (Section 2 AÜG). Each combination of agency worker and user company has its own end date.
Tracking it with ExpirySuite
- Add an entry for each agency worker at each user company and enter the end of the permitted maximum period, as you have calculated it under Section 1(1b), as the date.
- Email reminders arrive 60, 30, 14, 7 and 1 day before the date and on the day itself.
- Assign a responsible person, such as the agency's dispatcher or the user company's HR team; emails arrive in each recipient's language.
- If a date passes, managers get further reminders 3, 7 and 14 days later.
Frequently asked questions
- Does the 18-month period restart after a break?
- Only if more than three months lie between assignments at the same user company. With gaps of up to three months, earlier assignments count in full (Section 1(1b) sentence 2 AÜG).
- Does switching agencies reset the clock?
- No. Earlier assignments to the same user company by another agency also count (Section 1(1b) sentence 2).
- Can the maximum be longer than 18 months?
- Yes, through a sector collective agreement or a works or service agreement based on one; user companies not bound by a collective agreement may use up to 24 months under the conditions of sentence 6 (Section 1(1b) sentences 3 to 6).
- What happens if the maximum is exceeded?
- The contract with the agency becomes invalid and an employment relationship with the user company is deemed to exist, unless the worker makes a valid declaration in time that they wish to keep the agency contract (Section 9(1) no. 1b and (2), Section 10(1)).
