Refresh biocide competence certificates in time

In Germany, certain biocidal pest-control products may only be used by persons with proven competence (Section 15c(3) GefStoffV); the certificate is valid for six years and is extended by six years with each recognised refresher (Annex I No. 4.4(5)). The employer notifies use six weeks ahead (Section 15c(2)).

Certain biocidal products may only be used by persons who hold competence (Sachkunde) under Annex I no. 4.4 of the German Hazardous Substances Ordinance (GefStoffV) that covers the product in question (Section 15c(3)). This concerns pest control products of main group 3 under Annex V of Regulation (EU) No 528/2012 classified as acutely toxic category 1, 2 or 3, carcinogenic, germ cell mutagenic or toxic for reproduction category 1A or 1B, or specific target organ toxicity category 1, as well as products whose authorisation sets the user category "trained professional user" (Section 15c(1)). Instead of competence, a use-specific briefing is enough if the work is done under the direct and constant supervision of a competent person (Section 15c(4)).

Competence is proven by a certificate of successful completion of an officially recognised competence course with a theoretical and practical examination (Annex I no. 4.4(1) and (4)). Qualifications such as pest controller (Schädlingsbekämpfer) or certified pest controller count as equivalent for the respective areas of pest control (no. 4.4(2)). Competence certificates are valid for six years from the date of the certificate; validity is extended by six years each time from the date of a certificate of completing an officially recognised refresher course (no. 4.4(5)).

The employer notifies the competent authority in writing or electronically of the first use of such pest control products, and of restarting use after a break of more than one year, at least six weeks in advance, with the information listed in Annex I no. 4.2.1; changes are notified without delay (Section 15c(2)). Transitional deadlines: for recognised and equivalent competences, the first refresher must be proven by 28 July 2027 at the latest (Section 25(7)); anyone who could carry out a use without competence until 30 September 2021 must prove competence by 28 July 2027 (Section 25(2)).

Who is responsible?

The employer fulfils the duties under Section 15c(2) and (3) where such biocidal products are to be used (Section 15c(1)): it notifies the use and ensures that only competent persons, or persons briefed and supervised under Section 15c(4), use the products.

If the deadline passes

Using a biocidal product without the required competence, contrary to Section 15c(3), first sentence, is an administrative offence (Section 22(1) no. 29 GefStoffV). Failing to make a notification under Section 15c(2), or making it incorrectly, incompletely or late, is also an administrative offence (Section 21 no. 4).

Fumigation licence (Befähigungsschein)

Fumigation additionally requires a Befähigungsschein under Section 15d(4). It is issued for a maximum of six years and can be extended by six years at a time if the requirements are still met and a refresher course under no. 4.4(5) was completed before expiry. If the course cannot be attended in time because of undue hardship, the authority can extend validity by up to six months (Annex I no. 4.5(2) and (3)).
