Send your agency's monthly contract list in the first ten days

A Spanish temp agency (ETT) sends the labour authority's temp agency register, electronically and within the first ten days of each month, the list of assignment contracts concluded the previous month (Article 17.1 of Royal Decree 417/2015). It is sent even with no contracts; failing to send it is a serious offence.

A Spanish temporary work agency (ETT) must send the labour authority that granted its authorisation a list of the assignment contracts (contratos de puesta a disposición) it has concluded (Article 5.1 of Law 14/1994). The Regulation specifies that the list is sent electronically to the temporary work agency register of the competent labour authority within the first ten days of each month, using the official form, covering the contracts concluded in the previous month (Article 17.1 of Royal Decree 417/2015).

The list must include the name, tax number and social security account code of the user companies' workplaces; the number of contracts with each, broken down by legal ground; and the total number of workers assigned, counting each worker once even if assigned several times (Article 17.1.a to c). If no contract was concluded that month, the list must still be sent, stating this.

These lists go into the central database managed by the Directorate-General for Employment and are accessible to labour authorities (Article 14.1.e and 14.3).

Who is responsible?

The temporary work agency (Article 5.1 of Law 14/1994; Article 17.1 of the Regulation). It must also notify the labour authority within fifteen days of changes of ownership and registered office, of directors, the opening or closing of workplaces and ceasing to trade (Article 17.2).

If the deadline passes

Not sending the labour authority the information under Article 5 of Law 14/1994 as required by regulation is a serious offence by the agency (Article 18.2.b of the Social Order Offences and Penalties Act, LISOS).

Also in months with no activity

The duty does not depend on having assigned workers: if there were no assignment contracts in the previous month, the list is still sent, stating this (Article 17.1, last paragraph). A fixed monthly record therefore makes sense.
