Prepare the dangerous goods safety adviser's annual report on time

A German dangerous goods safety adviser must prepare the annual report on the company's dangerous goods transport within six months of the end of the financial year (Section 8(5) GbV). The company keeps it for five years and shows it to the authority on request (Section 9(3)); failures are an offence.

Companies involved in the transport of dangerous goods that have duties under the GGVSEB or the Dangerous Goods Ordinance for sea transport must appoint at least one dangerous goods safety adviser, unless the business owner performs the role personally (Section 3(1) of the German Dangerous Goods Safety Adviser Ordinance, GbV). The adviser prepares an annual report for the company on its dangerous goods transport activities within six months of the end of the financial year (Section 8(5), first sentence).

The report must at least contain: the type of dangerous goods by class, the total quantity in one of four bands (up to 5 tonnes, more than 5 to 50 tonnes, more than 50 to 1,000 tonnes, more than 1,000 tonnes), the number and type of accidents for which an accident report was prepared, other information the adviser considers important for assessing safety, and whether the company was involved in transport under ADR/RID/ADN 1.10.3 or IMDG Code 1.4.3 (Section 8(5), second sentence). Air transport need not be covered; the total quantity includes dangerous goods received (Section 8(5), third and fourth sentences).

The company keeps the annual report and the adviser's records for five years after they are submitted and presents them to the competent authority in text form on request (Section 9(3)). The ordinance does not apply to companies covered by an exemption under Section 2 GbV.

Who is responsible?

The safety adviser prepares the report (Section 8(5)). The company ensures that the adviser receives all relevant information and documents on dangerous goods transport and can properly perform all tasks assigned under Section 8 (Section 9(2) nos. 2 and 6). Retention and presentation to the authority are the company's job (Section 9(3)).

If the deadline passes

An adviser who fails to prepare the annual report, or prepares it incorrectly, incompletely or late, commits an administrative offence (Section 10 no. 3(d) GbV). So does a company that does not keep the report for at least five years or does not present it, or presents it late (Section 10 no. 1(f)).

Financial year, not calendar year

The deadline is tied to the end of the financial year (Section 8(5), first sentence). If the financial year ends on 31 December, the six months run to 30 June; with a different financial year the date moves accordingly.
