Request the extension in the final year, never after

SEMARNAT's authorisation to transport hazardous waste in Mexico lasts ten years (LGPGIR Regulation, Article 58). The carrier applies for an extension in the last year of validity and no later than 45 working days before expiry (Article 59); after that a new application is required.

The General Law for the Prevention and Integral Management of Waste (LGPGIR) requires an authorisation from the Ministry of Environment and Natural Resources (SEMARNAT) for the transport of hazardous waste and, more generally, for providing hazardous waste management services to third parties (Article 50, sections I, IV and VI). Authorisations are granted for a fixed term and may be extended under the Regulation (Article 53); they may be transferred only with SEMARNAT's prior written consent and if the conditions under which they were granted still hold (Article 51). For third-party services SEMARNAT requires a guarantee sufficient to cover possible damage, and it may revoke the authorisation if the guarantees are not renewed (Articles 81 and 82).

The application is filed on SEMARNAT's form with the details in Article 48 of the Regulation; carriers provide only the information in its sections I and II, plus a description of the waste, how it will be collected and transported and the vehicles to be used (Article 49, section IX), and submit the documents in sections I and II of Article 50 of the Regulation together with the proposed insurance or guarantees and copies of the federal transport authority's permits (Law, Article 80, sections IX and X; Regulation, Article 50, last paragraph). The decision period for collection and transport is thirty working days (Regulation, Article 55, section II). The authorisation states, among other things, the authorised activity, the waste covered, its number and its validity (Article 56, sections III, IV, VI and VII).

Authorisations for reuse, recycling, co-processing, treatment, incineration, operation of collection centres or transport are valid for ten years (Regulation, Article 58, section II). They may be extended for periods equal to the original one if the request is filed in the last year of validity and up to forty-five working days before expiry, the activity is the same, the waste has not changed and the applicant is the holder (Article 59, sections I to IV). SEMARNAT decides within thirty working days and, if that period passes without a decision, the extension is deemed granted (Article 59, third and fourth paragraphs). Changes are requested on SEMARNAT's form; a change of company name only needs a notice with the notarised shareholders' minutes (Article 60).

Collection and transport providers must check labelling and packaging, have a contingency plan and emergency equipment, trained staff, request and sign the generator's manifest and observe waste compatibility (Regulation, Article 85); the manifest circulates as an original and two copies among generator, carrier and recipient (Article 86). SEMARNAT suspends the authorisation if documents are forged or the original is altered (Article 62) and revokes it, among other grounds, for false information, for breaching waste management rules or for failing to renew guarantees (Law, Article 52).

Hazardous waste transport also requires the federal transport authority's permits, copies of which accompany the application (LGPGIR, Article 80 section X); those permits have their own rules and validity periods, which this page does not cover.

Who is responsible?

The transport service provider is the holder of the authorisation, requests the extension and maintains the guarantees (Regulation, Articles 59 and 61 section V; LGPGIR, Article 82). A generator that hires transport must hand the waste to authorised carriers and keep the manifests; if the original signed by the recipient is not returned within sixty calendar days, the generator informs SEMARNAT (Regulation, Article 86 section IV). The Federal Environmental Protection Agency (PROFEPA) may verify compliance before an extension is decided (Regulation, Article 59, second paragraph).

If the deadline passes

Transporting hazardous waste without the required authorisation is sanctionable under the Law and its Regulation (LGPGIR, Article 106 section I), as is failing to observe environmental protection measures during transport (Article 106 section XXIII). An authorisation that expires without a timely extension is not revived: the extension request must be filed in the last year and up to 45 working days before expiry (Regulation, Article 59 section I), so after that date a new application with the ordinary decision period applies (Article 55). SEMARNAT may also suspend or revoke the authorisation (Regulation, Article 62; LGPGIR, Article 52).

Ten years of validity, but the process starts a year early

Record the validity date shown in the authorisation letter as the expiry (Regulation, Article 56 section VII). The window for requesting the extension opens when the last year of validity begins and closes 45 working days before expiry (Article 59 section I); since ExpirySuite's earliest reminder is 60 days, consider an auxiliary record expiring one year before the end of the authorisation to open the file in time. The catalogue gives this type a 63-day preparation lead.

Tracking it with ExpirySuite

  1. Add a record per authorisation with the validity date in the letter as the expiry and, if you prefer, an auxiliary record expiring one year earlier to open the extension window.
  2. Email reminders arrive 60, 30, 14, 7 and 1 day before the expiry date and on the day; remember the extension request must be filed at least 45 working days before.
  3. The environmental officer can upload the authorisation or extension letter through a secure link that is valid for 14 days and needs no account.
  4. Assign the environmental or fleet manager as the responsible person; if the date passes without an extension, managers get further reminders 3, 7 and 14 days later.

Frequently asked questions

How long is the hazardous waste transport authorisation valid?
Ten years, the same as authorisations for reuse, recycling, treatment, incineration and operation of collection centres (LGPGIR Regulation, Article 58 section II). Final disposal has twenty-five years, and other activities with no express term between one and five years (Article 58 section I and last paragraph).
When is the extension requested?
In the last year of validity and up to forty-five working days before expiry, provided the activity and the waste are the same and the applicant is the holder (Regulation, Article 59 sections I to IV). The extension is for periods equal to the original authorisation.
What if SEMARNAT does not answer the extension request?
SEMARNAT decides within thirty working days of receiving the request, even without a verification visit; if that period passes without a decision, the extension is deemed granted (Regulation, Article 59, third and fourth paragraphs).
Can the authorisation be transferred to another company?
Only with SEMARNAT's prior written consent and proof that the conditions under which it was granted still hold (LGPGIR, Article 51). A mere change of company name is handled with a notice accompanied by the notarised shareholders' minutes (Regulation, Article 60, third paragraph).
What must the carrier do on each shipment?
Check labelling and packaging, have a contingency plan, emergency equipment and trained staff, request the generator's original manifest, sign it and keep its copies, and observe waste compatibility; waste containing infectious agents may not travel with other hazardous waste (Regulation, Articles 85 and 86).
