Never let an agent in your agency work on an expired licence

In Quintana Roo, the real estate agent registration is valid for two or four years from issue and is renewed within the non-extendable 30 calendar days after expiry (Real Estate Services Law, Article 11). Without it the agent cannot operate and faces fines, suspension or cancellation (Articles 14 and 26).

In Quintana Roo, real estate promotion, brokerage, administration, management and consultancy are governed by the State Real Estate Services Law (Ley de Prestación de Servicios Inmobiliarios), enforced by the Ministry of Sustainable Urban Territorial Development, SEDETUS (Article 1). Providing real estate services requires a current registration (matrícula) and real estate certificate (constancia) issued by the Ministry; only individuals holding them may present themselves as accredited real estate professionals or property administrators, and only registered companies may call themselves real estate agencies, whose staff must in turn hold their own registration as individuals (Article 5, third to fifth paragraphs).

The law classifies providers as real estate promoters, housing promoters, real estate advisers, real estate agencies and property administrators (Article 6). To enter the register, individuals prove identity, address, experience and training, tax registration and, where relevant, regular migration status with permission for paid work; companies file their articles of incorporation, the representative's power of attorney, address, the list of advisers acting on their behalf, who must be registered as individuals, and an express undertaking that those advisers will complete the required training, which is essential for later renewals of the company's registration (Article 8). Once the requirements are met, the Ministry issues the registration and certificate and adds them to the register (Article 9); the certificate states, among other details, the issue date, number and validity of the registration (Article 10, sections VI and VII).

The registration and certificate are valid for two or four years from issue and must be renewed and updated; for renewals the law grants a non-extendable period of up to thirty calendar days after expiry to complete the procedure, subject to the requirements of the law and its regulations (Article 11, first paragraph). At each renewal, personal details are updated and completion of the annual training and updating courses required and delivered by the Ministry with the State Real Estate Council is documented (Article 11, second paragraph). Training is mandatory in every category: 90 hours for the initial registration and 30 hours for renewal, evidenced by diplomas, certificates or attestations from recognised institutions, or certification in the sector's competence standard (Article 16).

Providers must obtain and renew their registration, pass the mandatory training programmes, report any change to their file in the Ministry's information system within 30 calendar days, allow inspection visits and show their registration to clients (Article 12, sections I to V and X). Agencies must have at least one responsible adviser, arrange the registration of the people they hire so they join the register within 90 calendar days and report hires and departures within 30 working days (Article 13); companies give written notice of advisers joining or leaving within the following thirty working days (Article 9, second paragraph). The public register shows registered providers with their validity and status (Article 24, section II).

The law refers renewal requirements and the category to which each validity period applies to its regulations; this page reflects only what the law itself says. The current law was published on 6 September 2024 and repealed the 2014 law; existing providers had twelve months to obtain their licence, and current registrations kept their rights until their next update (third and fourth transitory articles).

Who is responsible?

Each real estate service provider obtains and renews their own registration and certificate and proves their training (Article 12, sections I to III). The real estate agency is responsible for the performance of the advisers acting on its behalf, arranges their registration and reports hires and departures (Articles 8, point 2, item e, 9 and 13). The Ministry grants, renews, refuses, suspends and cancels registrations, keeps the register and carries out verification visits (Articles 4, sections II, III and X, and 25).

If the deadline passes

Without a current registration and certificate, real estate promotion and brokerage services may not be provided (Articles 5 and 14, last paragraph). Breaches of the law lead to a warning or reprimand, a fine, suspension of the licence and register entry for up to ninety calendar days, or cancellation of the registration and removal from the register for three years (Article 26); presenting oneself as a provider without a licence or obstructing verification visits is fined (Article 28), and acting in a category other than the one held leads to a 90-day suspension up to a three-year cancellation (Article 29). Sanctions are recorded in the public information system (Article 34). The law sets fine amounts in measurement units; they are not reproduced here.

The validity is printed on the certificate

Record the validity date shown on each adviser's or the agency's certificate as the expiry (Article 10 section VII); it will be two or four years from issue (Article 11). The law allows up to 30 calendar days after expiry to renew, but during that period the registration is no longer current, so it is best to finish the procedure beforehand. Open one record per individual and another for the company, because the agency's renewal depends on its advisers' training (Article 8, point 2, item f).

Frequently asked questions

How long is a real estate adviser's registration valid in Quintana Roo?
Two or four years from the day of issue, under the State Real Estate Services Law (Article 11). The specific validity is stated on the certificate itself (Article 10 section VII). The law refers the requirements for each case to its regulations.
Can I renew after it expires?
The law grants a non-extendable period of up to thirty calendar days after expiry to complete the renewal procedure, subject to the requirements (Article 11). Beyond that period no renewal is provided for and, without a current registration, real estate services may not be provided (Article 5).
What training is required?
90 hours for the initial registration and 30 hours for renewal, evidenced by diplomas, certificates or attestations from institutions recognised by the Ministry with the Real Estate Council, or certification in the sector's competence standard; holders of a higher technical degree in real estate marketing only need annual updating (Article 16). Each renewal also requires proof of the annual updating courses the Ministry requires (Article 11).
What must an agency do about its advisers?
Have at least one responsible adviser, request the registration of each person it hires or help them obtain it so they join the register within 90 calendar days, and report hires and departures within 30 working days (Article 13); renewal of the agency's own registration requires proof of its advisers' training (Article 8, point 2, item f).
What happens if I operate without a registration?
Presenting oneself as a real estate service provider without a licence is fined (Article 28 section I), and breaches of the law in general can lead to suspension for up to ninety days or cancellation of the registration and removal from the register for three years (Article 26). Sanctions are recorded in the publicly searchable information system (Article 34).
